Esta investigación se enmarca en una pregunta concreta: ¿qué habilita para que ciertas autoridades públicas puedan participar o intervenir en el proceso de las políticas públicas en Colombia? Una lectura económica diría que lo anterior sucede porque las fuerzas del mercado, por sí mismas, no lograron resolver el asunto, o porque el Estado debe proveer bienes y servicios públicos, entre otros. Desde la sociología, podrían abordarse narrativas, construcciones sociales o tal vez fenómenos que afectan dicho contexto. Desde la psicología, se mencionarían probablemente algunos sesgos, normas sociales u otros asuntos concernientes al individuo que logran trascender a la esfera de lo público. Sin embargo, en el libro se propone un abordaje interdisciplinar entre el derecho (en sus ramas del derecho constitucional y administrativo) y las políticas públicas. En efecto, el autor considera que el principio de legalidad (muy propio de Estados con fuerte raigambre legalista como Colombia) explica cuándo una autoridad (entidad, organismo, servidor público, etc.) debe participar o intervenir en el proceso de políticas públicas. Incluso, la investigación afirma que un análisis de política que no considere el derecho dentro del enfoque multidisciplinario sería un análisis meramente idealista.
