Inhaltsangabe:Einleitung: Das Schlagwort Finanzmarktstabilisierung hielt im Zuge der Finanzmarktkrise Einzug in den deutschen Sprachwortschatz. Was aber ist Finanzmarktstabilisierung? Geläufige Lexika, selbst Wikipedia , lassen die Frage unbeantwortet. Konkreter wird der Begriff in den sperrigen Titeln mehrerer Bundesgesetze: Dies gilt zunächst für das Finanzmarkstabilisierungsgesetz (FMStG), welches am 17.10.2008 vom Deutschen Bundestag einschließlich des Finanzmarktstabilisierungsfondsgesetzes (FMStFG) und des Finanzmarktstabilisierungsbeschleunigungsgesetzes (FMStBG) verabschiedet wurde. Auf dem FMStG bauen Finanzmarktstabilisierungsergänzungsgesetz (FMStErgG, Inkrafttreten am 9. April 2009) und Finanzmarktstabilisierungsfortentwicklungsgesetz (FMStFEntwG, Inkrafttreten am 18. Juli 2009) auf. Diese Gesetze sind eine Reaktion des Gesetzgebers auf die Finanzmarktkrise , die sich in Deutschland ab September 2008 in erheblicher Weise in Finanz- und Realwirtschaft bemerkbar machte. Die auf Verwerfungen am US-Hypothekenmarkt zurückgehende Finanzmarktkrise löste nach h.M. befördert durch das fair value-Prinzip der internationalen Rechnungslegung hohe Wertberichtigungen in den Bankbilanzen aus. Daraus ergaben sich starke Belastungen des Eigenkapitals der Kreditinstitute bis zur Insolvenz (-nähe). Es folgte eine fundamentale Vertrauenskrise auf dem Interbankenmarkt, der zum Erliegen kam. In Form einer restriktiven Kreditausreichung schlug sich so die oft geäußerte Auffassung der Kapitalmangel der Banken als Kreditverknappung ( credit crunch ) auf die Realwirtschaft nieder. Ziel der Finanzmarkstabilisierung in Deutschland war daher die Sicherstellung der Zahlungsfähigkeit von Finanzinstituten, eine Revitalisierung des Interbankenhandels, und mittelbar eine Verbesserung der Kreditversorgung der Realwirtschaft. Als stabilisierende Maßnahmen für Unternehmen des Finanzsektors sieht das FMStFG staatliche Garantien (§ 6 FMStFG), Rekapitalisierung (§ 9 FMStFG) und die Übernahme von Risikopositionen vor (§ 8 FMStFG). Eine zentrale Rolle bei der Umsetzung der Maßnahmen kommt dem in § 2 FMStFG eingerichteten Sonderfonds Finanzmarkstabilisierung (SoFFin) und der in § 3a FMStFG errichteten Finanzmarktstabilisierungsanstalt (FMSA) zu: Aus dem von der FMSA verwalteten Fonds werden Garantien und Kapitalhilfen gewährt. Banken spielen für die heutige Weltwirtschaft eine zentrale Rolle, da sie als Finanzintermediäre auftreten und den notwendigen Ausgleich zwischen Kapitalbedarf und Kapitalangebot schaffen. In keiner anderen Branche sind daher so große Auswirkungen - positive als auch negative - auf andere Industriezweige möglich. Dies haben vor allem die finanzwirtschaftlichen Krisen der letzten Jahre bewiesen. Neben der Bank als Institution kommt aber vor allem den Mitarbeitern der Bank eine hohe Bedeutung zu, da diese direkt die Geschicke der Bank und indirekt so die Geschicke von Privathaushalten, Wirtschaftsunternehmen und sogar Staaten lenken können. Umso erstaunlicher ist, dass auch in Zeiten der Finanzkrise sehr hohe leistungs- und erfolgsorientierte Vergütungen an Bankmitarbeiter gezahlt wurden, so der Vorwurf der Kritiker. Immerhin galten Banken und somit in erster Linie die Mitarbeiter der Banken, als Hauptverantwortliche für eine weltweite Rezession. Ein großer Widerspruch, auch mit politischer Brisanz, ist dabei von vielen neutralen Beobachtern empfunden worden.

Die Finanzkrise 2007-2009 stellte die betroffenen Staaten vor die Herausforderung, effektive Massnahmen zur Stabilisierung der Finanzmarkte zu ergreifen. Dabei stand die vielfach geausserte Forderung, "das Notige" zu tun im Spannungsverhaltnis zu den Bedingungen der verfassungsrechtlich determinierten Systeme der Gewaltenteilung. Das in Deutschland und den USA jeweils auf nationalstaatlicher Ebene umgesetzte Finanzkrisenmanagement begrundete deshalb trotz seiner Erfolge bei der Stabilisierung der Finanzmarkte verfassungsrechtlichen Aufarbeitungsbedarf.Der deutsche Gesetzgeber ubertrug weite Entscheidungsgewalt zur Finanzmarktstabilisierung an die Exekutive. Im Gegensatz zu den USA verzichtete er allerdings auf die Schaffung wirksamer Kontrollmechanismen und Transparenzpflichten. Stefanie Egidy arbeitet rechtsvergleichend die Entscheidungsparameter, Zielkonflikte und Grenzen des jeweiligen staatlichen Finanzkrisenmanagements heraus. Sie zeigt, dass die deutschen Massnahmen aufgrund ihrer Legitimationsdefizite auch in zukunftigen Finanzkrisen keine Vorbildwirkung entfalten durfen.
