Knowledge of the pragmatici sheds new light on pragmatic normative literature (mainly from the religious sphere), a genre crucial for the formation of normative orders in early modern Ibero-America. Long underrated by legal historical scholarship, these media – manuals for confessors, catechisms, and moral theological literature – selected and localised normative knowledge for the colonial worlds and thus shaped the language of normativity. The eleven chapters of this book explore the circulation and the uses of pragmatic normative texts in the Iberian peninsula, in New Spain, Peru, New Granada and Brazil. The book reveals the functions and intellectual achievements of pragmatic literature, which condensed normative knowledge, drawing on medieval scholarly practices of ‘epitomisation’, and links the genre with early modern legal culture. A new history of Brazil’s eighteenth century that foregrounds debates about wealth, difference, and governance Transformations in Portugal and Brazil followed the discovery of gold in Brazil’s hinterland and the hinterland’s subsequent settlement. Although earlier conquests and evangelizations had incorporated new lands and peoples into the monarchy, royal officials now argued that the extraction of gold and the imperatives of rivalry and commerce demanded new approaches to governance to ensure that Brazil’s wealth flowed to Portugal and into imperial networks of exchange. Using archival records of royal and local administrations, as well as contemporary print culture, Kirsten Schultz shows how the eighteenth-century Portuguese crown came to define and defend Brazil as a “colony” that would reinvigorate Portuguese power. Making Brazil a colony entailed reckoning with dynamic societies that encompassed Indigenous peoples, Africans, and Europeans; the free and the enslaved; the wealthy and the poor. It also involved regulating social relations defined by legal status, ancestry, labor, and wealth to ensure that Portuguese America complemented and supported, rather than reproduced, metropolitan ways of producing and consuming wealth.

Esta obra tem como objetivo analisar de forma comparada as Supremas Cortes dos Estados Unidos da América e do Brasil e seus sistemas de prestação jurisdicional, a fim de descrever suas particularidades e verificar se houve efetiva implementação de elementos do sistema jurídico norte-americano no Direito brasileiro, especialmente o sistema de precedentes, com posição crítica e contrária a respeito. A elaboração deste estudo científico se fundamentou em pesquisa bibliográfica, mais precisamente na coleta de doutrina a respeito da temática no âmbito do Direito Constitucional, bem como em levantamentos jurisprudenciais que enfatizaram as duas Supremas Cortes. Ao longo da pesquisa foram estudados os sistemas jurídicos do common law e do civil law, a atuação das Supremas Cortes mencionadas, e, por fim, as diferenças e semelhanças entre os sistemas jurídicos e a problemática envolvendo a implementação de mecanismos do common law pelo Brasil. Por meio da leitura e da interpretação desta dissertação, depreende-se que cada sistema jurídico guarda sua singularidade, historicidade, base e cultura, e a implementação de mecanismos de sistemas estrangeiros sem o arcabouço necessário traz uma perspectiva deveras sombria especialmente para o Estado Democrático de Direito, derruindo garantias fundamentais constitucionais.
