It is over 10 years since Professor George Hampel, former Supreme Court Judge and Daniel Gurvich, criminal law barrister published the first edition of Bail Law in Victoria. Since that time the Bail Act 1977 has been amended numerous times, it has been reviewed by the Victorian Law Reform Commission and has been interpreted in light of the Charter of Human Rights and Responsibilities Act 2006. In this 2nd edition of the book Professor George Hampel, Daniel Gurvich and Sarah Bruhn, who prior to becoming a barrister at the Victorian Bar worked at the Supreme Court of Victoria assisting with management of bail applications, provide a timely update of the law on bail in Victoria. A comprehensive review of the case law is provided. The authors identify the potential issues that lawyers need to be aware of when applying for (or opposing) bail. The original format of the book has been maintained where possible and additional chapters on the Charter of Human Rights and Responsibilities Act 2006 and the history of bail in Victoria are included. As with the original edition of Bail Law in Victoria the authors seek to provide a comprehensive yet easy to read text to assist lawyers in providing the best advice and advocacy.

The commission's Review of the Bail Act Final Report was tabled in parliament on Wednesday 10 October 2007. The Final Report makes 157 recommendations to ensure the Bail Act functions simply, clearly and fairly. Major recommendations include; restructuring and rewriting the Act in plain English, streamlining the bail decision-making process, requiring decision makers to consider victims' safety and welfare, the Department of Justice taking control of the education and administration of bail justices and requiring police to check if someone is already on bail when making the bail decision.

"Victoria is experiencing an 'incarceration crisis', caused by an unprecedented growth in prisoner numbers. The key driver of this growth is the increasing number of persons who are denied bail and remanded into custody. As of 31 May 2019, 38% of adult prisoners in Victoria were being held on remand. The increase in the remand population is gendered, with higher rates for women - nearly half the women in Victorian prisons are now being held on remand. It is also contributing to the incarceration crisis with indigenous offenders, as Aboriginal and Torres Strait Islander peoples are disproportionately represented among those remanded. Moreover, there are signs that pre-trial detention in Victoria is increasing. In 2017-18, Victoria had the largest increase in prisoners held on remand of any Australian State or Territory. Recent reforms to bail law are likely to further contribute to this trend by further restricting eligibility for bail. What lies behind the increased number of persons being held on remand, and the changes to bail law? A comparison of bail laws and parliamentary debates in Victoria in 1977 (when the Bail Act was introduced) and 2017-18 (the most recent substantive reforms) reveals escalating concern about community protection; that is, the need to protect the community by remanding into custody those persons deemed to present a risk of committing offences if released on bail."--Page 1.
