The banking industry is now required to provide banking facilities to all the eligible citizens and financial inclusion is driven in that direction. Financial literacy is the need of the hour. The competency levels of bankers plays a significant role in spreading financial literacy. This book provides necessary tools for bankers to improve their competency level, not only in spreading financial literacy, but also in all areas of banker-customer relationships. Even though the banker-customer relationship is governed by numerous laws, the bond between the banker and customer is beyond them. The cases and case laws cited in the book provide an insight to the banker-how he should work within the framework of law and, at the same time, not dissatisfy the customer. The banker should be a friend, philosopher and guide to the customer. Deficiency of service is well explained in the book. This will be an eye opener to the banker and help to avoid deficiencies in banking services. The book also contains a chapter on "Guidelines for Customers" which will be helpful in customer education. Increased awareness of the customers leads to demanding better services. Failure to provide the desired level of services or deficiency in the services provided gives way to litigation. Banks spend a lot of time, energy and resources to defend themselves in cases filed by their customers. Hence, it is all the more necessary that banks equip themselves with updated knowledge of their customers' rights and bankers' obligations. The book has also covered, in detail decided cases in banking business, product by product. The book is written in a lucid style, which will be understood not only by the bankers and lawyers, but also by the customers.

The question of how financial services should be regulated in the interests of consumers has never been more topical. The structure of the financial services industry is changing rapidly and the need for the law to keep pace with these changes has never been greater. This book examines the role of the law in the protection of the consumer, in particular the ways in which the law is, and could be, used to protect consumers when purchasing financial services. A prominent panel of contributors first examines the role of the European Union and the ombudsmen schemes operating in the United Kingdom in improving consumer protection. Eight expert papers present a detailed analysis of aspects of the various legal mechanisms protecting consumers in the banking, financial services, investments and insurance industries. The final part of the book is concerned with the important and controversial area of consumer credit. This unique work is a welcome contribution to a rapidly developing area of law, which has so far received little attention from commentators. It will be of great interest to those at the cutting edge of banking, financial services and consumer law, whether practicing lawyers or in-house counsel, and all those involved in advising consumers.

Regulation of the banking industry has undergone substantial changes over the past decade. In response to the 2007-2009 financial crisis, many new bank regulations were implemented pursuant to the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 or under the existing authorities of bank regulators to address apparent weaknesses in the regulatory regime. Chapter 1 provides a broad overview of selected banking-related issues, including issues related to "safety and soundness" regulation, consumer protection, community banks, large banks, what type of companies should be able to establish banks, and recent market and economic trends. Chapter 2 provides a broad overview of various banking topics--key concepts in banking, overview of regulation, recent banking legislation, and policy issues.Banks generally must comply with a variety of requirements to hold minimum levels of capital. Chapter3 provides a brief overview of these requirements and examines related policy issues. Chapter 4 first provides background information on the consumer data industry and various specialty areas. It then examines one prominent specialty area--consumer scoring--and describes various factors used to calculate credit scores. Next, it provides a general description of the current regulatory framework of the consumer data industry. Finally, the chapter discusses selected policy issues pertaining to consumer data reports. Chapter 5 provides an overview of consumer lending markets, pricing, and legislative efforts designed to facilitate efficient credit allocation and pricing. The 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank; P.L. 111-203) established the Bureau of Consumer Financial Protection (CFPB) to implement and enforce federal consumer financial law while ensuring consumers can access financial products and services as reported in chapter 6. Chapter 7 reports on the results of the audits of the fiscal years 2017 and 2016 financial statements of the Bureau of Consumer Financial Protection, known as the Consumer Financial Protection Bureau (CFPB), which is incorporated in the enclosed Financial Report of the Consumer Financial Protection Bureau for Fiscal Year 2017.Chapter 8 provides an overview of how accounting and auditing standards are created and regulated in the private sector, the federal government, and state and local governments

With 2000+ pages of guidance, this important new textbook provides an extensive and in-depth guide to the current labyrinthine regulatory regime relating to consumer and SME credit (by way of cash loans) and protection generally, including the Consumer Protection Code, the Consumer Credit Act (housing loans and non-housing loans), the EU Consumer Credit Regulations, the EU Mortgage Credit Regulations and the Central Bank Housing Loan Regulations. Other lending-related conduct of business requirements are also covered in detail, including the Code of Conduct on Mortgage Arrears, the Lending to SME Regulations, the Code on Related Parties Lending and the Credit Reporting Act, together with applicable EBA/ECB Guidelines dealing with loan origination, product oversight and governance, non-performing exposures/loans and arrears. The regulated activities triggering authorisation as a retail credit firm or credit servicing firm are also addressed in detail. The book additionally extends beyond lending to have application to the wider business of regulated firms in the financial services arena, dealing in detail with issues including the general principles and requirements of the Consumer Protection Code, the fitness and probity regime including the area of minimum competency, distance marketing requirements and other background to the regulatory regime in Ireland including the increased regulatory focus on the culture of regulated firms and product oversight and governance. The available redress/recourse mechanisms are also covered, including the Financial Services and Pensions Ombudsman, the Credit Review Office, the regulatory and other consequences of breach of applicable requirements and the significant risk management area for regulated firms of their customers' statutory right to redress on breach of financial services legislation. In addition, the book has relevance to professionals dealing with consumers in any contractual context including extensive treatment of how the concept of 'consumer' has developed under common law, the unfair commercial practices regime and the increasingly topical area of unfair contract terms legislation. Relevant case law of the Irish courts and other common law jurisdictions, together with an expanding corpus of decisions from the CJEU, are addressed in detail. This book's practical style is designed to assist bankers, other regulated firms, lawyers, compliance professionals and regulators in the application of a complex area. Rather than simply setting out the separate requirements, the book seeks to navigate the at times contradictory legislative and regulatory strands to give (in so far as is possible) a coherent sense of how they integrate. Much of the content is unique and cannot be found in any other publication. An essential addition to the library of every lender, practitioner and compliance and regulatory risk professional, particularly in the areas of consumer and SME credit.
