Bei der Ausgestaltung von Risikotragf„higkeitsans„tzen geben das KWG und die MaRisk die maágeblichen rechtlichen Rahmenbedingungen vor. Zus„tzlich existiert mit dem von BaFin und Bundesbank gemeinsam ver”ffentlichten Leitfaden zur aufsichtlichen Beurteilung bankinterner Risikotragf„higkeitskonzepte ein Positionspapier, in welchem die Bankenaufsicht ihre Beurteilungskriterien hinsichtlich der Erfllung der rechtlichen Anforderungen darlegt. Methodisch lassen sich Risikotragf„higkeitsans„tze in Abh„ngigkeit von der verfolgten Absicherungszielsetzung und der verwendeten Methode zur Ableitung des Risikodeckungspotenzials in jeweils zwei miteinander kombinierbare Grundtypen unterteilen, sodass insgesamt vier verschiedene Ans„tze voneinander abgegrenzt werden k”nnen. Sofern das prim„re Ziel in der Absicherung von Ansprchen der Eigenkapitalgeber liegt, handelt es sich um einen Fortfhrungsansatz. Wenn die Zielsetzung hingegen auf die Absicherung von Gl„ubigeransprchen ausgerichtet ist, handelt es sich regelm„áig um einen Liquidationsansatz. Was die Ermittlung des Risikodeckungspotenzials betrifft, kann zwischen bilanzorientierten und wertorientierten Ans„tzen differenziert werden. W„hrend bei bilanzorientierten Ans„tzen die Ableitung des Risikodeckungspotenzials in nicht unerheblichen Ausmaá von den Rechnungslegungsvorschriften beeinflusst wird, erfolgt die Ermittlung des Risikodeckungspotenzials bei wertorientierten Ans„tzen losgel”st von Rechnungslegungsvorschriften und ohne Beachtung der Regelungen zum regulatorischen Mindesteigenkapital. Auf der Risikoseite sehen die MaRisk mindestens die Einbeziehung der vom Institut als wesentlich eingestuften Risiken vor. Fr die Quantifizierung verwenden die meisten Institute einen VaR-Ansatz. Sowohl der berechnete Risikobetrag einer einzelnen Risikoart als auch der aggregierte Betrag fr das Gesamtbankrisiko wird in nicht unerheblichem Ausmaá durch die Wahl der Risikoquantifizierungsparameter wie Konfidenzniveau, Haltedauer und Beobachtungszeitraum sowie den in die Rechnung einbezogenen Risikoverbundeffekten determiniert. Auf der einen Seite ist zu beachten, dass aus methodischer Sicht sowohl den unterschiedlichen Ans„tzen zur Ableitung des Risikodeckungspotenzials als auch den verschiedenen Absicherungszielsetzungen Grenzen gesetzt sind. Insgesamt k”nnen durch eine Kombination von Fortfhrungsansatz mit bilanzorientierter Ableitung des Risikodeckungspotenzials und Liquidationsansatz mit wertorientierter Ableitung des Risikodeckungspotenzials die jeweiligen methodischen Schw„chen kompensiert und die Gefahr von Fehlsteuerungsimpulsen minimiert werden. Dennoch existiert aufgrund der aufsichtsrechtlichen Žnderungen mit Basel III, sich „ndernder Rechnungslegungsvorschriften und der Tatsache, dass viele Modelle zur Quantifizierung von Risiken sich noch im Anfangsstadium der Entwicklung befinden, ein nicht zu vernachl„ssigender Weiterentwicklungsbedarf.
