"Executive Summary: The objective of integrated management is to replace the current fragmented approach to ocean management with a more collaborative and coordinated approach. Canada's Beaufort Sea is a high priority area in which to implement oceans management activities because of: the existence of co-management structures under comprehensive land claim settlement with the Inuvialuit; well-established subsistence fish and marine mammal resource harvesting; the Beaufort Sea Beluga Management Plan, and other western Arctic management plans; and significant renewed interest in oil and gas resource development. The existing co-management structures in place provide opportunities to develop or enhance models of oceans governance appropriate to Canada's north. The Beaufort Sea Integrated Management Planning Initiative (BSIMPI) is being developed with the Inuvialuit in accordance with the Inuvialuit Final Agreement and DFO Integrated Management Planning Framework. The planning process is operating at two levels, the large ocean area scale of the Beaufort Sea and smaller community-based initiatives nested within the larger area. Specifically, the process will focus on initiatives related to the development of a management plan for ocean-related activities in the Inuvialuit Settlement Region. This plan will place particular emphasis on coastal areas in support of the existing Beaufort Sea Beluga Management Plan. The BSIMPI will demonstrate the need for National Integrated Management of Canada's marine waters. This report represents a first step in the planning process for the Beaufort Sea Integrated Management Planning Initiative. A coastal resource inventory has been compiled synthesizing various sources of information to document environmental, social and cultural, and economic uses within the study area. Each of the discussed resource sectors is visually complimented by maps developed using ArcView GIS. "Executive Summary: Canada's Oceans Act was passed in 1997. It directs that integrated management should be undertaken to ensure the sustainable use and health of marine ecosystems. One aspect of this broad objective is the development of an effective planning process. Such a process will identify social, cultural, environmental and economic values, thus providing a solid basis for the development of management plans. In 1999 the Inuvialuit, the Department of Fisheries and Oceans and industry agreed to collaborate in the development of integrated management planning for marine and coastal areas in the Inuvialuit Settlement Region. This agreement is called the Beaufort Sea Integrated Management Planning Initiative (BSIMPI). Under BSIMPI the Senior Management Committee (SMC) seeks to guide initiatives related to the development of a management planning process for ocean-related activities in the Beaufort Sea. The SMC also formed a Working Group to implement effective collaboration on Oceans management initiatives. The first major task assigned to the Working Group was to evaluate a proposal for the establishment of a pilot Marine Protected Area (MPA) in the Inuvialuit Settlement Region. The primary objectives of this proposed MPA would be to conserve and protect important subsistence beluga whale and anadromous fisheries. The area selected for consideration as a MPA was consistent with the areas zoned as 1(a) in the Beaufort Sea Beluga Management Plan (BSBMP). The BSBMP was developed and implemented to ensure sustainable beluga management in a manner reflective of the Inuvialuit Final Agreement (IFA). Of the five zones defined by the BSBMP, Zone 1(a) are the most protected. The process for evaluating the merits of an area proposed for consideration as a MPA under the Oceans Act is outlined in the National Framework for Establishing and Managing Marine Protected Areas. Part of the evaluation process includes the completion of 3 assessments: a Socio-economic Assessment; an Ecological Assessment; and a Technical Assessment. According to the National Framework the Technical Assessment provides an overview of the proposed MPA from the point of view of the level of public and stakeholder support for the establishment of the MPA; management related issues including those of co-management and management resources; appropriate boundaries and adjacent uses. Accordingly, these topics form the basis of this document. Results of this Technical Assessment indicate that the area of interest, namely the BSBMP Zone 1(a), could feasibly be designated a MPA under the Oceans Act. Public and stakeholder support for the proposed MPA is sufficient to warrant continuation of the evaluation process. Existing co-management arrangements including BSIMPI and the Fisheries Joint Management Committee (FJMC) have the capacity to provide some managerial support for the proposed MPA, but would likely need additional resources, or collaborative efforts, to manage the proposed MPA comprehensively. Modifications to the boundary of the proposed MPA may be necessary if alternative measures for dealing with existing significant discovery licenses are not acceptable to the license holders. Three recommendations are provided to conclude this report. They are premised on the assumption that a decision is made to continue to the next level of evaluation of the proposed MPA. [1] That the issue of the significant discovery licenses which overlap in the Kendall Island Zone l(a) be addressed early in the process, [2] That the existing BSBMP be used as a basis for beginning further discussions if the decision is made to proceed to the next level of evaluation of the proposed MPA, [3] That Community, partner, and stakeholder consultations continue in order to ensure extensive input into the final decision and into selecting the type of management arrangement appropriate for the proposed MPA. Considerable regulatory overlap currently exists in terms of the environmental assessment process in the Beaufort Sea region, with up to three levels of review existing for proposed projects. ... Navigating the legislation, regulations and agreements governing activities in the Beaufort Sea can be a complex task. When seeking project approvals, permits and licences, there may be multiple federal government departments, territorial government departments and Aboriginal groups to contact .... With each governing body, there may exist unique regulatory processes, and legislated terms and conditions that must be met. For proponents, this can lead to increased costs and an increased risk of regulatory duplication. Where possible, a "single window" regulatory approach should be implemented such that proponents need only contact a single regulatory authority for a given type of approval, e.g. permits and licences for oil and gas exploration and operations, or environmental impact assessments. When a "single window" approach is not possible, it would be recommended that federal authorities participate in the development of guides for the various permitting processes related to activities conducted in the Beaufort Sea. Such guides have been developed for oil and gas exploration for areas throughout Canada with the support from INAC, Natural Resources Canada, provincial governments and industry stakeholders .... "Introduction: This report examines the regulatory framework for a proposed marine protected area in an integrated management planning context, in order to understand the responsibilities of different government departments and agencies for integrated management and marine protection in Canadian Arctic Ocean and Beaufort Sea. This report contains two parts. The first part of the report is contained in chapters 1 to 5. The first three chapters contain this introduction, a discussion of the proposed marine protected area, and a discussion of private and commercial interests affecting the marine protected area. Chapter 4 reviews the international framework for integrated management and protection. Chapter 5 then discusses the Canadian framework for integrated management and marine protection. The second part of the report is contained in chapter 6 to 8. This portion of the report is an analysis of the different federal and territorial government departments and agencies, and their responsibilities for integrated management and marine protection. There is also a discussion of joint management boards and processes established in the Inuvialuit Final Agreement. The report concludes that a cooperative approach is required by all government departments and agencies to implement integrated management and marine protection in the Canadian Arctic Ocean. Further, existing legislation and plans provide sufficient tools to implement integrated management and marine protection. This legislation and plans may function in cooperation with voluntary approaches by private parties: It is often easier to understand government responsibilities in the context of a fact scenario. The fact scenario is a proposed marine protected area for beluga whales and beluga whale habitat in the Canadian Beaufort Sea. The protected area is located in the delta where the Mackenzie River flows into the Beaufort Sea. Given its location, the proposed marine protected area will be affected by oil and gas exploration and development in the offshore waters of the Beaufort Sea. It will also be affected by upstream developments on the Mackenzie River, and land-based developments in the Northwest and Yukon Territories. ... The first portion of the report continues in chapter 2 by discussing the proposed marine protected areas in the Mackenzie River and Beaufort Sea. Chapter 3 is a discussion of the private and commercial interests affecting the protected area. International and alternative approaches to marine protection are then considered in chapter 4. Finally, chapter 5 contains a discussion of the Canadian framework for marine protection. This chapter includes a summary of the role of departments and agencies for integrated management and marine protection in the Canadian Arctic Ocean and Beaufort Sea; illustrative tables; and analysis of the possible role of voluntary initiatives in implementing the proposed marine protected area in the Canadian Beaufort Sea. This chapter also functions as an executive summary and conclusions for the report. The second portion of the report then provides a more detailed examination of the responsibilities of government departments and agencies for integrated management, marine protection and the proposed marine protected area in the Canadian Arctic Ocean and Beaufort Sea. The North American Arctic addresses the emergence of a new security relationship within the North American North.
