English summary: Since the Reformation, research in theology and jurisprudence has focused on the legal form of the church and the definition of its theological character, a fact which has at times given rise to controversy and has caused some estrangement between theologians and legal experts in the Protestant religion. These have had an effect on church legislation and the application of the law, on the relationship between the church and the state and on the method of dealing with individual questions pertaining to current controversial issues. Hans Martin Muller attempts to mediate between the theological and the legal points of view in ecclesiastical law and the profession of faith. The purpose of his study is to examine the significance of theology for the practice of governing the church and for the Protestant understanding of the office of the church as well as the connection between the concept of the church and the church order. German description: Die Rechtsgestalt der Kirche und ihre theologische Wesensbestimmung ist seit der Reformation ein zentraler Forschungsgegenstand in Theologie und Jurisprudenz, der zum Teil zu Kontroversen und im evangelischen Bereich auch zu einer gewissen Entfremdung zwischen Theologen und Juristen gefuhrt hat. English summary: Martin Honecker deals with the debate on fundamental principles in Protestant ecclesiastical law, with the question of the theological prerequisites of ecclesiastical law and with the necessary differentiations, such as for example between the law pertaining to the established churches and the law of organization within the church. Die Erfahrungen im Kirchenkampf haben die Aufmerksamkeit auf die Bedeutung des Rechts und der Ordnung der Kirche gerichtet. Es entstand auf juristischer Seite eine evangelische Rechtstheologie, die in der evangelischen Theologie und im Theologiestudium freilich allenfalls eine marginale Rolle spielt. Martin Honecker befasst sich zum einen mit der Grundsatzdiskussion im evangelischen Kirchenrecht, mit der Frage nach den theologischen Voraussetzungen von Kirchenrecht und mit notwendigen Unterscheidungen wie dem Staatskirchenrecht, dem innerkirchlichen Organisationsrecht und dem Recht des geistlichen Auftrags. Dazu ist die Berucksichtigung wesentlicher geschichtlicher Entwicklungen evangelischen Kirchenrechts notwendig. Weiterhin diskutiert der Autor konkrete Probleme im Uberschneidungsfeld von Theologie und Recht, wie Fragen der Kirchenmitgliedschaft und Kirchenzugehorigkeit, von Kirchenzucht, Visitation, Lehrbeanstandung, innerkirchlichen Grundrechten oder der Auswirkung der Okumene auf das Kirchenrecht. So soll auf der einen Seite Theologen deutlich gemacht werden, welches Gewicht das Kirchenrecht in der kirchlichen Praxis hat.
