Im Gegensatz zu Gewerbetreibenden wurde den freiberuflich Tätigen traditionell eine altruistische Berufseinstellung in ihrer eigenpersönlich und auf Grund der besonders qualifizierten Ausbildung fachlich unabhängigen Berufsausübung zugeschrieben. Diese idealistische Komponente ist heute zunehmend einer marktorientierten Strukturanpassung gewichen. Der Gesetzgeber hat – neben der Entwicklung des vormals »schmutzigen Gewerbes« hin zu einer Dienstleistungswirtschaft – mit der von ihm geschaffenen Heterogenität der freien Berufe im Berufskatalog des §18 Abs. 1 Nr. 1 Einkommensteuergesetz dazu beigetragen, dass beide Erwerbsbereiche kaum noch unterscheidbar sind. Freie Berufe weisen daher keine Wesensmerkmale (mehr) auf, die geeignet sein könnten, ihre bestehende Sonderstellung in der Rechtsordnung zu rechtfertigen. In contrast to traders, liberal professionals were traditionally regarded as altruistic and independent in pursuing their work due to their high professional qualification. This idealistic component has been replaced by an increasing market-oriented structural adjustment. Apart from the development of the former »dirty trade« to a service-oriented business, the government has contributed to the fact that both sectors are hardly distinguishable by creating a heterogeneity of liberal professions in the job catalogue of section 18 (1) sentence 1 of the German Income Tax law. As a result, liberal professions hardly have any characteristics which are suitable for justifying their existing special role in jurisdiction.

Poverty, increased inequality, and social exclusion are back on the political agenda in Western Europe, not only as a consequence of the Great Recession of 2008, but also because of a seemingly structural trend towards increased inequality in advanced industrial societies that has persisted since the 1970s. How can we explain this increase in inequalities? Policies in labor markets, social policy, and political representation are strongly linked in the creation, widening, and deepening of insider-outsider divides--a process known as dualization. While it is certainly not the only driver of increasing inequality, the encompassing nature of its development across multiple domains makes dualization one of the most important current trends affecting developed societies. However, the extent and forms of dualization vary greatly across countries. The comparative perspective of this book provides insights into why Nordic countries witness lower levels of insider-outsider divides, whereas in continental, liberal and southern welfare states, they are more likely to constitute a core characteristic of the political economy. Most importantly, the comparisons presented in this book point to the crucial importance of politics and political choice in driving and shaping the social outcomes of deindustrialization. While increased structural labor market divides can be found across all countries, governments have a strong responsibility in shaping the distributive consequences of these labor market changes. The European Union is unique amongst international organisations in that it has a highly developed and coherent system of judicial protection. The rights derived from Union law can be enforced in court, as opposed to other international organisations whereby enforceability is often far less certain.
