De Rossetti di Scander, i. R. Consigliere di Governo, cavaliere di terza classe della Corona ferrea rappresentato dal procuratore signor Giov. Batta Enea di Rossetti, come da mandato di data 17 maggio 1843, e l' i. R. Magistrato politico economico nelle rappresen tanze del Municipio di Trieste per autorizzazione dell' Eccelso i. R. Governo di data 3 giugno 1843, n 13127 venne convenuto quanto segue: il Municipio di Trieste per la sua civica Biblio teca, accetta il legato disposto dal suddetto defunto con Codicillo di data 2 giugno 1839 all'art. Cioè le sezioni numeri 1. Il, lll, V, VI della di lui biblioteca, cosi dal defunto testatore divise e classificate; a. La prima sezione comprende la raccolta delle edizioni delle opere del Petrarca di manoscritti antichi e moderni, di quadri, stampi, gessi, marmi, disegni e scritti del testatore e memorie relative a questo illustre italiano, nonché di alcune medaglie; La seconda sezione è composta di elementi consimili spettanti ad Enea Silvio Piccolomini l'io il Papa), colla giunta di molti suoi autografi e d' altri di sua famiglia; La terza sezione abbraccia le opere per l'illustra zione della vita e degli scritti dei suddetti due autori; La quinta sezione abbraccia la poligrafia ed il rimanente della sua biblioteca; La sesta sezione abbraccia i libri spettanti al diritto marit timo, gli autografi e le relative litografie del progetto, ed accessori del Codice marittimo. Che il defunto testatore compilava per onoranda imperiale disposizione; Queste sezioni si trovano già separate e distinte, descritte sia regolarmente in apposito inventario giudiziale, già consegnate alla civica Biblioteca, per il che il Magistrato ne fa col presente ampia confessione diricev1mentu; La quinta sezione, cioè la collezione di libri poligrafici passa ad essere incorporata colla Biblio teca, e soggiacera alle discipline e dispositive che valgano per questa; 9 Le altre sezioni Il, lll, Vi, ° verranno custodite unite in una stanza della biblioteca, vi si formerà di queste apposito repositorio; si conserverà l'ordine del catalogo secondo il sistema avviato dal testatore, né se ne per metterà mai l'uso ad alcuno fuori delle stanze della Biblioteca medesima; il Municipio di Trieste assegna alle sezioni uno e due, cioè alla raccolta Patriarchesca (sic) e Piccolonnnea. Sulle proprie rendite, in perpetuo l'annua dotazione di fiorini cento (f. 100) moneta di convenzione effettiva d'argento esclusa qualunque carta monetata o moneta rappresentativa che non abbia peso 0 valore intrinseco pari al nominale. Quest' annua dotazione verrà esclusivamente destinata alla conservazione ed aumento di queste due prime sezioni; A maggiore e durevole garanzia della dotazione annua, il Magistrato assegna in ipoteca lo stabile urbano in Trieste di sua proprietà, segnato col 11. 1015, nel quale è collocata la civica Biblioteca, e si obbliga di fare intavolare il presente atto di assegna zione e fondazione. Eseguita per tale modo scrupolosamente la volontà dei testatore, le parti con traenti segnarono di proprio pugno il presente istrumento, del quale un esemplare rimarrà a mani dell'i. R. Magistrato, altro a mani dell'esecqe testamentario signor Antonio de Rossetti, una copia verrà depositata alla civica Biblioteca.
