This qualitative-experiential research explores the influence of Bill C-31 on individual concepts of identity and gender. It includes interviews with 11 individuals who acquired Indian status through the 1985 Bill C-31, Amendments to the Indian Act. In particular, I examine the application process and raise questions regarding gendered experiences. Calls for the provision of group rights are a common part of politics in Canada. Many liberal theorists consider identity claims a necessary condition of equality, but do these claims do more harm than good? To answer this question, Caroline Dick engages in a critical analysis of liberal identity-driven theories and their application in cases such as Sawridge Band v. Canada, which sets a First Nation’s right to self-determination against indigenous women’s right to equality. She contrasts Charles Taylor’s theory of identity recognition, Will Kymlicka’s cultural theory of minority rights, and Avigail Eisenberg’s theory of identity-related interests with an alternative rights framework that account for both group and in-group differences. Dick concludes that the problem is not the concept of identity itself but the way in which prevailing conceptions of identity and group rights obscure intragroup differences. Instead, she proposes a politics of intragroup difference that has the power to transform rights discourse in Canada.

The concept of Indian status is problematic and is experienced as a phenomenon that can be both positive and negative. The phenomenon investigated in this research is that of status loss for various reasons: a) marrying-out, b) unknown and unstated paternity, and c) second generation cut-off. At this point in history the Indian Act is being questioned regarding gender discrimination that restricts Status transmission for First Nations women in comparison to First Nations men. Throughout this research Bill C-3 was proposed, read in parliament, and eventually passed as legislation to promote gender equality in Indian Registration. On January 31st 2011 Bill C-3 became law and is now know as the Gender Equity in Indian Registration Act. However, it is important to note that the struggle for equality is not complete with the addition of this amendment for reasons to be discussed in this research. As a First Nations woman experiencing the phenomena that result from the Indian Act's restrictions of status transmission for First Nations women I wanted to hear from other women in my situation. I also wanted to hear from women experiencing other forms of status transmission restrictions and give them the opportunity to have a voice against legislation that attempts to undermine them. The Indian Act elicits different responses, perceptions, and emotions when it comes to defining who is an Indian' and who is not eligible. It is these varying opinions that I sought out with the co-researchers in this study in order to provide a document that is inclusive and safe for discussion. --P. ii.

Canada is often called a pluralist state, but few commentators view Aboriginal self-government from the perspective of political pluralism. Instead, Aboriginal identity is framed in terms of cultural and national traits, while self-government is taken to represent an Aboriginal desire to protect those traits. Shifting Boundaries challenges this view, arguing that it fosters a woefully incomplete understanding of the politics of self-government. Taking the position that a relational theory of pluralism offers a more accurate interpretation, Tim Schouls contends that self-government is better understood when an “identification” perspective on Aboriginal identity is adopted instead of a “cultural” or “national” one. He shows that self-government is not about preserving cultural and national differences as goods in and of themselves, but rather is about equalizing current imbalances in power to allow Aboriginal peoples to construct their own identities. In focusing on relational pluralism, Shifting Boundaries adds an important perspective to existing theoretical approaches to Aboriginal self-government. It will appeal to academics, students, and policy analysts interested in Aboriginal governance, cultural studies, political theory, nationalism studies, and constitutional theory.

In this pathfinding book, Bonita Lawrence reveals the ways in which mixed-blood urban Natives understand their identities and struggle to survive in a world that, more often than not, fails to recognize them. In ?Real? Indians and Others Lawrence draws on the first-person accounts of thirty Toronto residents of Native heritage, as well as archival materials, sociological research, and her own urban Native heritage and experiences. She sheds light on the Canadian government?s efforts to define Native identity through the years by means of the Indian Act and shows how residential schooling, the loss of official Indian status, and adoption have affected Native identity.
