As possibilidades econômicas geradas pelas biotecnologias aliadas a um arcabouço jurídico que permitiu a extensão dos direitos de propriedade intelectual para formas de vida e conhecimento alteraram profundamente o sentido e o valor da biodiversidade, intensificando o movimento de apropriação e degradação, no Hemisfério Sul, dos recursos genéticos e dos conhecimentos das comunidades locais. Durante séculos, o acesso a essa diversidade social e biológica por países e empresas transnacionais do Norte ocorreu sem qualquer controle ou contraprestação. Buscando uma compensação por este tipo de apropriação injusta, a Convenção da Diversidade Biológica (CDB) dispôs sobre a necessidade de se estabelecer um sistema de repartição de benefícios e de controle no acesso a referidos recursos, como forma de garantir a conservação e o uso sustentável da biodiversidade e resguardar os direitos das comunidades locais. Após anos de vigência desse Tratado, a repartição de benefícios não conseguiu sair do papel. O presente trabalho pretende verificar a viabilidade de um Regime Internacional de Repartição de Benefícios, atualmente em discussão no âmbito da CDB, quanto à sua efetividade para a conservação da biodiversidade e para a proteção dos direitos das comunidades tradicionais. Para tanto, a abordagem é realizada a partir de uma visão integrada da realidade, lançando mão do pensamento complexo, em particular, da visão sistêmica da vida cunhada por Fritjof Capra, bem como de outros autores, como Edgar Morin, Enrique Leff e Vandana Shiva, o que implica no reconhecimento do valor intrínseco da biodiversidade, independente de seu valor econômico. A pesquisa vai buscar as raízes da atual crise da sóciobiodiversidade, decorrente da insustentabilidade do atual modelo de desenvolvimento econômico e do paradigma científico reducionista que o informa. Nessa perspectiva, passa a demonstrar o sentido e a importância da biodiversidade, sua valoração e usos, destacando a profunda alteração no seu significado operada pela emergência das novas biotecnologias no mercado e pela expansão de um regime global de direitos de propriedade intelectual. Abordam-se, ainda, as alterações introduzidas pela CDB no tocante ao regime de acesso e à proteção dos direitos das comunidades tradicionais, analisando-se o mecanismo de repartição de benefícios e as dificuldades de implementação, para finalmente discutir a viabilidade de um Regime Internacional de Acesso e Repartição de Benefícios para a finalidade da conservação da biodiversidade e da proteção do conhecimento tradicional. The economic possibilities generated by biotechnology, linked to a legal structure that permitted the extension of intellectual property rights to life forms and to knowledge, altered profoundly the meaning and value of biodiversity, intensifying the appropriation and degradation of genetic resources and local community knowledge in the Southern Hemisphere. During centuries, the access to this social and biological diversity by countries and transnational companies of the North had occurred without any control or compensation. The Convention on Biological Diversity (CBD), conceived to address this type of unjust appropriation, was to create a system to share the benefits and to control the access of these resources as a means of guaranteeing the conservation and sustainable use of biodiversity and the protection of the rights of local communities. Years after this treaty had been ratified, the sharing of benefits never became a reality. The present study seeks to verify the viability of an international regime of benefit sharing, now being discussed within the CBD, as to its effectiveness for the conservation of biodiversity and the protection of traditional communities. The approach is based on an integrated view of reality, using the systemic vision of life used by Fritjof Capra, and others philosophers like Edgard Morin, Enrique Leff e Vandana Shiva, one that implies the recognition of the intrinsic value of biodiversity, independent of its economic value. This research analyzes the roots of the current sociobiodiversity crisis based on the unsustainable current model of economic development and itssupporting, reductionist scientific paradigm. Based on this perspective, the thesis demonstrates the importance of biodiversity, its value and uses, emphasizing the change caused by the emergence of new market biotechnologies and by the expansion of a global regime of intellectual property rights. Also addressed are the changes introduced by the CBD with respect to the access and protection of the rights of traditional communities, analyzing the mechanisms for benefit-sharing and the difficulties for implementation. Finally, is discussed the viability of an international regime of access and sharing of benefits for the conservation of biodiversity and protection of traditional knowledge.

A presente obra objetivou analisar a influência das práticas culturais da comunidade tradicional Kalunga, do município de Monte Alegre de Goiás, na proteção e preservação do meio ambiente. A Comunidade possui modo específico de produzir e viver, que estão ligados aos saberes adquiridos pelos seus ancestrais. Para eles, a natureza é divina e regula as relações e as ações humanas. Há tempo de plantar e tempo de colher. É considerada um território de povos tradicionais, remanescentes de quilombos, filhos de ex-escravos, oriundos de antigos núcleos de mineração de ouro, existentes na época da colonização do estado de Goiás nos séculos XVII e XVIII, especialmente de Arraias, Monte Alegre de Goiás e Cavalcante. Povos e Comunidades Tradicionais, conforme o Decreto 6.040/2007, são grupos culturalmente diferenciados e que se reconhecem como tais, que possuem formas próprias de organização social, que ocupam e usam territórios e recursos naturais como condição para a sua reprodução cultural, social, religiosa, ancestral e econômica, utilizando conhecimentos, inovações e práticas geradas e transmitidas pela tradição. E são essas práticas promovidas pelos povos tradicionais, que assumem um papel relevante, que permite a proteção do meio ambiente quanto ao uso dos recursos naturais, tornando suas atividades sustentáveis.

O trabalho aborda a questão complexa da proteção do conhecimento tradicional associado à biodiversidade dos povos indígenas a partir da concepção do pluralismo jurídico de teor comunitário-participativo idealizado por Antonio Carlos Wolkmer. Estabelece que as tentativas de proteção jurídica dos conhecimentos tradicionais dos Povos Indígenas, no cenário internacional, não decorrem das próprias necessidades fundamentais desses sujeitos coletivos sob a premissa de que no âmbito dos fóruns internacionais multilaterais as tentativas de proteção foram formatadas pelo desejo ocidental de enquadrar os sistemas sociais e culturais dos povos indígenas no direito de propriedade intelectual e dos benefícios financeiros daí advindos. Nessa perspectiva e a partir da contextualização do processo histórico e econômico da globalização e da apropriação dos conhecimentos tradicionais, faz uma abordagem dos princípios informativos introduzidos pela Convenção da Diversidade Biológica, de 1992, no que tange à proteção do conhecimento tradicional dos povos indígenas. Enfoca, ainda, o tratamento da questão nos fóruns internacionais como a Organização Mundial do Comércio e a Organização Mundial de Propriedade Intelectual, bem como pelos opositores do sistema vigente de propriedade intelectual, cujo pensamento progressista é idealizado por ambientalistas de organizações sociais dos países megadiversos, tais como Índia, através de Vandana Shiva, Malásia, com Gurdial Nijar e Tewolde Egziabher, na Etiópia, cujas propostas encontram ressonância no Brasil, na Colômbia e no Equador, países latino-americanos onde a riqueza da biodiversidade não pode estar dissociada da presença indígena e das comunidades tradicionais. Por fim, o trabalho traça alguns fundamentos com base no pluralismo jurídico que devem nortear a construção de um regime de proteção do conhecimento tradicional dos povos indígenas que implique na emancipação e autodeterminação desses povos. This work tackles the complex issue of the protection of the traditional knowledge associated with the biodiversity of the indian people through the conception of legal pluralism, comunitary-participative, idealized by Antonio Carlos Wolkmer. It also establishes that the legal protective attempts of indian people ́s traditional knowledge, in the international scenario, are not consequense of the own fundamental necessities of such collective subjects, since, for the internationally multilateral forums, the protection attempts have been formatted by the Western desire of shaping the social and cultural systems of such people in the right of intellectual property as well as its financial benefits. In this perspective, by the contextualization of the economic and historical process of globalization and by the appropriation of traditional knowledge, it approaches the informative principles introduced by the Biological Diversity Convention, from 1992, about the protection of indian people ́s traditional knowledge. It also focuses on the way this issue is dealt with in international forums, such as the World Commerce Organization and Intellectual Property World Organization, as well as by the opposers to the present system of intellectual property, whose progressive ideas are idealized by environmentalists of social organizations from mega-diverse countries as India, with Vandana Shiva, Malasia, with Gurdial Nijar, and Ethiopia, with Tewolde Egziabher, whose propositions echo in Brazil, Colombia, Equador and Venezuela, American Latin countries, where biodiversity richness can not be dissociated from the indian presence and traditional communities. Finally, this work traces some fundaments based on the legal pluralism, which must guide a protection regime construction of indian people ́s traditional knowledge, enabling the emancipation and self-determination of such people.
