Bioethics and the Human Goods offers students and general readers a brief introduction to bioethics from a “natural law” philosophical perspective. This perspective, which traces its origins to classical antiquity, has profoundly shaped Western ethics and law and is enjoying an exciting renaissance. While compatible with much in the ethical thought of the great religions, it is grounded in reason, not religion. In contrast to the currently dominant bioethical theories of utilitarianism and principlism, the natural law approach offers an understanding of human flourishing grounded in basic human goods, including life, health, friendship, and knowledge, and in the wrongness of intentionally turning against, or neglecting, these goods. The book is divided into two sections: Foundations and Issues. Foundations sketches a natural law understanding of the important ethical principles of autonomy, non-maleficence, beneficence, and justice and explores different understandings of “personhood” and whether human embryos are persons. Issues applies a natural law perspective to some of the most controversial debates in contemporary bioethics at the beginning and end of life: research on human embryos, abortion, infanticide, euthanasia, the withdrawal of tube-feeding from patients in a “persistent vegetative state,” and the definition of death. The text is completed by appendices featuring personal statements by Alfonso Gómez-Lobo on the status of the human embryo and on the definition and determination of death.

A concise and accessible introduction to natural law ethics, this book introduces readers to the mainstream tradition of Western moral philosophy. Building on philosophers from Plato through Aquinas to John Finnis, Alfonso Gómez-Lobo links morality to the protection of basic human goods--life, family, friendship, work and play, the experience of beauty, knowledge, and integrity--elements essential to a flourishing, happy human life. Gómez-Lobo begins with a discussion of Plato's Crito as an introduction to the practice of moral philosophy, showing that it requires that its participants treat each other as equals and offer rational arguments to persuade each other. He then puts forth a general principle for practical rationality: one should pursue what is good and avoid what is bad. The human goods form the basis for moral norms that provide a standard by which actions can be evaluated: do they support or harm the human goods? He argues that moral norms should be understood as a system of rules whose rationale is the protection and enhancement of human goods. A moral norm that does not enjoin the preservation or enhancement of a specific good is unjustifiable. Shifting to a case study approach, Gómez-Lobo applies these principles to a discussion of abortion and euthanasia. The book ends with a brief treatment of rival positions, including utilitarianism and libertarianism, and of conscience as our ultimate moral guide. Written as an introductory text for students of ethics and natural law, Morality and the Human Goods makes arguments consistent with Catholic teaching but is not based on theological considerations. Few want to die young or to suffer, yet not all the money in the world can deliver physical immortality or a life free of suffering. In addition, health care needs differ. As a result, unless a state coercively forbids those with the desire and means to buy better basic health care to do so, access to medicine will be unequal. No co- try can afford to provide all with the best of care. In countries such as China, there are in addition stark regional differences in the quality and availability of health care, posing additional challenges to public policy-making. Further, in China as elsewhere, the desire to lower morbidity and mortality risks has led to ever more resources being invested in health care. When such investment is supported primarily by funds derived from taxation, an increasing burden is placed on a country’s economy. This is particularly the case as in China with its one-child policy, where the proportion of the elderly population consuming health care is rising. Western philosophy has long nurtured the hope to resolve moral controversies through reason; thereby to secure moral direction and human meaning without the need for a defining encounter with God or the transcendent. The expectation is for a moral rationality that is universal and able adequately to frame and guide the moral life. Moral and cultural unity was sought though philosophical reflection on human nature and the basic goods of a properly nurtured and virtuous life—that is, through appeal to what has come to be called the natural law. The natural law addresses permissible moral choice through objective understandings of human nature and human goods. Persons are obligated to act in ways that are compatible with creating and integrating the basic human goods into their lives and the lives of others. Such goods provide the basis for practical reasoning about virtuous choices and immediate reasons for action. The goal is the making of rational choices in the pursuit of a virtuous, flourishing, human life. Natural law theorists have argued extensively against human cloning, abortion, and same-gender marriage. Yet, whose assumptions regarding human nature should guide our understanding of the basic goods that mark the full flourishing human life? Moreover, why should nature, even human nature, be thought of as a moral boundary beyond which one must not trespass? Persons may wish actively to direct human evolution, utilizing the tools of both imagination and biotechnology. Perhaps nature is simply a challenge to be addressed, overcome, and set aside. This volume is a critical exploration of natural law theory.

This work offers a comprehensive understanding rooted in Catholic anthropology and moral theory of the meaning and limits of informed and proxy consent to experimentation on human subjects. In particular, it seeks to articulate the rationale for proxy consent in both therapeutic and nontherapeutic settings. As to the former, the book proposes that the Golden Rule, recognizing the basic inclinations of human nature toward objective goods perfective of human persons, should underpin the notion of proxy consent to experimentation on humans. As to the latter, an additional scrutiny of the amount of risk involved is necessary, since the risk-benefit ratio frequently invoked to justify higher-risk therapeutic research does not exist in its nontherapeutic counterpart. This study discusses a number of possible solutions to this question and develops a position that builds upon the objective notion of the human good.
