The key element of the territorial and maritime dispute between Bahrain and Qatar was the need to determine sovereignty over the area of Zubarah, the Hawar Islands and Janan Island. On the matter of sovereignty over Zubarah, the ICJ ruled in Qatar's favor, relying on an international treaty signed in 1913, between the Ottoman Empire and Great Britain, which declared the autonomy of the Al Thani family over the entire peninsula. The territorial dispute over the Hawar Islands was the most bitterly fought of the entire case. Qatar invoked the principle of contiguity and the vague concept of territorial unity to prove its claim, while the basis of Bahrain's argument rested on a decision made by Great Britain on July 11, 1939, that awarded sovereignty to Bahrain. Based on this decision, the ICJ ruled that the islands belonged to Bahrain. Since the Court had found that the Hawar Islands belonged to Bahrain, the single maritime boundary between Qatar and Bahrain had to be drawn between the Islands and Qatar's coasts. However, the channel between them was shallow and at some points during low-tide it is feasible, as was proved without challenge by Qatar, to walk from one side to the other, which made it seemingly impossible to navigate between different points of Qatar's southwestern coastline without entering Bahraini waters. While some parts of the ICJ's judgment were not rendered satisfactorily, ultimately a territorial dispute, which gravely embittered the relations between two friendly states, has been successfully settled.

This case study examines the development and eventual resolution of a long-standing territorial dispute between two small Arab states, Bahrain and Qatar. The dispute turned into a conflict in which traditional mediation did not succeed, but formal international adjudication did. The decision of those two small states to subject themselves voluntarily to a binding verdict, one not subject to appeal, is remarkable in its own right. Part A describes the background to the conflict, the key leaders involved, the issues at stake, and the initial International Court of Justice (ICJ) ruling that it had jurisdiction to rule on the dispute. The verdict is described in Part B. The generational change represented by the Bahraini and Qatari leaders, both new, allows consideration of the importance of individual actors in such disputes. The case study also illustrates the fact that seemingly insignificant disputes can be complicated. The case study can be used in specialized courses in conflict resolution or international law, an introductory international politics class, or a Middle East politics course. It is appropriate for all collegiate levels; however, students would be well served by having modest knowledge of either international law or the Middle East before tackling this case. The International Court of Justice (ICJ) is the principal judicial organ of the United Nations (UN). It was established 62 years ago at the end of the Second World War, and is the successor to the Permanent Court of International Justice (PCIJ) that was functioning at the time of the League of Nations. The ICJ has a dual role: to settle in accordance with international law the legal disputes submitted to it by states; and to give Advisory Opinions on legal questions referred to it by certain organs of the United Nations and duly authorized specialized agencies. Over the past six decades of the ICJ’s existence, the world has changed immensely. Dozens of newly independent countries, especially in Africa and Asia, have entered the world stage, and in the early 1970s, the Gulf states of the UAE, Qatar, Oman and Bahrain came to independence. The ICJ lives in the real world—changes in the world around us have their impact here, too. We have seen an increase in the range and number of states coming to the Court. Seventy nine states have engaged in Court proceedings in the past decade. The Court has handed down 95 judgments in its 60 years of existence. Of those, one-third has been delivered in the last decade. Today approximately 300 treaties refer to the Court in relation to the settlement of disputes arising from their application or interpretation and there has been a distinct trend for states to withdraw reservations they have made to such treaties in earlier years. The UAE, and the Gulf states more generally, are important to the ICJ. Since its establishment in 1971, the UAE has played a vital role in the affairs of the region, and has decided explicitly to base its foreign policy on the principles outlined in the Charter of the United Nations. It has formed close ties with countries throughout the Middle East and Asia, as well as with western nations. The Court appreciates the UAE’s interest in its work and, as with all parties to the Statute, stands ready to assist the states of the region in conformity with its Charter role.
