This book explores pathways to redress for main groups of victims/survivors of the 1992-5 Bosnian war —families of missing persons, victims of torture, survivors of sexual violence, and victims suffering physical disabilities and harm. The author traces the history of redress-making for each of these groups and shows how differently they have been treated by Bosnian authorities at the state and subnational level. In Bosnia and Herzegovina, thousands of war victims have had to suffer re-traumatising ordeals in order to secure partial redress for their suffering during 1992–1995 and after. While some, such as victims of sexual violence, have been legally recognised and offered financial and service-based compensation, others, such as victims of torture, have been recognized only recently with a clear geographical limitation. The main aim of the book is to explore the politics behind recognizing victimhood and awarding redress in a country that has been divided by instrumentalized identity cleavages, widespread patronage and debilitating war legacies. It shows how war victims/survivors navigate such fragmented and challenging public landscape in order to secure their rights.

It was from Argentina, in the years 1976 to 1983, that the world heard the cries of the families of los desaparecidos, the disappeared--20,000 to 30,000 people made to vanish forever by official sleight of hand. In the years since, the scope and range of governmentally sanctioned kidnappings has spread exponentially, making enforced disappearances a truly global problem. This volume provides an in-depth legal investigation of involuntary disappearances as defined by national and international law. Beginning with a detailed discussion of what constitutes an enforced disappearance, it goes on to consider how various international organizations such as the United Nations view this problem. Using the Multiple Rights Approach, enforced disappearances are examined as a violation of internationally defined basic rights such as the right to personal freedom, the right to protection against torture and the right to a judicial remedy. Viewpoints of the Inter-American Court of Human Rights and the European System of Protection are scrutinized with special consideration regarding the international laws applicable to the problem. The availability (or lack thereof) of restitution and compensation for material damage, mental and physical anguish, and loss of opportunity is also addressed. Finally, the work considers the need for a comprehensive and coherent framework when dealing with enforced disappearances.

This book provides a sociological account of the events in Bosnia in the 1990s, including ethnic cleansing, mass rape, and the role of political journalists. Drawing upon a diverse group of social theorists, including Merton, Weber, and Baudrillard, Sociology After Bosnia constructs a social understanding of the experiences of people in Bosnia and the response of Western leaders to these experiences. Beyond looking at the social causes of these events, Doubt sheds light on why Bosnia and Kosovo have largely been ignored by sociologists. He shows why the personal and social tragedies of people in Bosnia and Kosovo and the world's tolerance of these tragedies challenge contemporary sociological knowledge. Doubt argues that sociologists must be willing not only to recognize this challenge, but also to respond to it in order to construct meaningfully adequate accounts of war and genocide in a postmodern era. Doing so, he contends, may yield an important and needed reconsideration of the existing body of sociologicial knowledge and a revision of how this knowledge is applied.
