An examination of accounting and management techniques which have been suggested for use in making government management more businesslike. It is observed that the utility of some business techniques is quite limited in government. For one thing, resources can be used only as authorized by Congress. Also, managers' salaries in government are notoriously less than those available to successful business managers. It is proposed that efforts be directed toward improving personal incentives for resource management.

Americans have a love-hate relationship with government. Rejecting bureaucracy—but not the goods and services the welfare state provides—Americans have demanded that government be made to run like a business. Hence today’s privatization revolution. But as Jon D. Michaels shows, separating the state from its public servants, practices, and institutions does violence to our Constitution, and threatens the health and stability of the Republic. Constitutional Coup puts forward a legal theory that explains the modern welfare state as a worthy successor to the framers’ three-branch government. What legitimates the welfare state is its recommitment to a rivalrous system of separation of powers, in which political agency heads, career civil servants, and the public writ large reprise and restage the same battles long fought among Congress, the president, and the courts. Privatization now proclaims itself as another worthy successor, this time to an administrative state that Americans have grown weary of. Yet it is a constitutional usurper. Privatization dismantles those commitments to separating and checking state power by sidelining rivalrous civil servants and public participants. Constitutional Coup cements the constitutionality of the administrative state, recognizing civil servants and public participants as necessary—rather than disposable—components. Casting privatization as an existential constitutional threat, it underscores how the fusion of politics and profits commercializes government—and consolidates state power in ways both the framers and administrative lawyers endeavored to disaggregate. It urges—and sketches the outlines of—a twenty-first-century bureaucratic renaissance.

Principal-agent problems are largely responsible for poor corporate governance. Much work on private sector corporate governance reform seeks to address transparency, accountability and responsiveness to stakeholder interests under the new category of corporate social responsibility. Yet, these issues are not new. The public sector has been working on these issues for many years - especially in looking at ways of reducing malfeasance and also optimizing use of resources for the benefit of principals. Some lessons from public sector reform include promoting information dissemination, participation, and balancing powers between a corporation's executive and supervisory entities. While firms should not necessarily be administered like governmental bodies, there are many lessons from public sector organisational reform and institutional governance that may be applicable to large-scale public corporations.

The evergreen debate over government's involvement in business continues in earnest. Participants straddle all stakeholder groups, from the state itself to the private sector to the public at large. Add to that debate increasing globalisation, and now de-globalisation, and the advent of technological advances. Criticism is often levelled at a government that is slow to act or one that belatedly introduces damning regulations. Many governments are already saddled with demands spanning mega infrastructural development to bulging fiscal deficits to evening out growth across the population. The politics of the day are however synonymous with short-termism. The Covid-19 pandemic has increased the bailout burden even more. The author attempts to provide a fair assessment of the potentially complementary roles that the public and private sectors can play in a fast-changing global economy, amidst the shifting expectations of society.Related Link(s)
