Courts, like other government institutions, shape public policy. But how are courts drawn into the policy process, and how are patterns of policy debate shaped by the institutional structure of the courts? Drawing on the experience of the Brazilian federal courts since the transition to democracy, Judging Policy examines the judiciary's role in public policy debates. During a period of energetic policy reform, the high salience of many policies, combined with the conducive institutional structure of the judiciary, ensured that Brazilian courts would become an important institution at the heart of the policy process. The Brazilian case thus challenges the notion that Latin America's courts have been uniformly pliant or ineffectual, with little impact on politics and policy outcomes. Judging Policy also inserts the judiciary into the scholarly debate regarding the extent of presidential control of the policy process in Latin America's largest nation. By analyzing the full Brazilian federal court system—including not only the high court, but also trial and appellate courts—the book develops a framework with cross-national implications for understanding how courts may influence policy actors' political strategies and the distribution of power within political systems.

This study sheds new light on the Brazilian communist movement and how the specter of the USSR influenced mid-twentieth century Brazilian foreign policy. Between 1918 and 1961, Brazil and the USSR maintained formal diplomatic ties for only thirty-one months, at the end of World War II. Yet, despite the official distance, the USSR is the only external actor whose behavior, real or imagined, influenced the structure of the Brazilian state in the twentieth century. In Brazil and the Soviet Challenge, 1917–1947, Stanley Hilton examines Brazilian policy toward the Soviet Union during this period. Drawing on American, British, and German diplomatic archives and unprecedented access to official and private Brazilian records, Hilton elucidates the connection between the Brazilian elite’s perception of a communist threat and the creation of the authoritarian Estado Novo (1937–1945), the forerunner of the post-1964 national security state. Hilton shows how the 1935 communist revolt generated irresistible pressure for an authoritarian government to contain the Soviet threat; details the Brazilian government’s secret cooperation with the Gestapo during the 1930s and its concomitant efforts to forge an anti-Soviet front in the Southern Cone; and uncovers Brazil’s attempt to build counterintelligence capabilities in neighboring countries.

Brazil has a long tradition of public policies and efforts to eradicate hunger and poverty. The right to food is enshrined in Amendment No. 64/2010 of Brazil’s Constitution as an obligation of the State, and the country has a very progressive food security law that institutionalizes the policy and lays the foundations for broad-based social participation in priority setting, expressed in the National Council on Food and Nutrition Security (CONSEA). It was this wealth of experience (reflected in programmes and plans such as Zero Hunger, Bolsa Família and Brazil Without Extreme Poverty, applied nationwide from 2003 to 2013), together with other factors, that took the country off the Hunger Map in 2014. This report is designed to update the information and describe concrete Brazilian initiatives to facilitate South-South cooperation to a wider audience, including policymakers working to improve food security and fight poverty. In other words, it is a manual of good practice for public au thorities, technical personnel, NGOs and the general public in other Latin American, Caribbean and African countries

Beginning in the late 1970s, activists from the favelas of Rio de Janeiro challenged the conditions—such as limited access to security, sanitation, public education, and formal employment—that separated favela residents from Rio's other citizens. The activists built a movement that helped to push the nation toward redemocratization. They joined with political allies in an effort to institute an ambitious slate of municipal reforms. Those measures ultimately fell short of aspirations, and soon the reformers were struggling to hold together a fraying coalition. Rio was bankrupted by natural disasters and hyperinflation and ravaged by drug wars. Well-armed drug traffickers had become the new lords of the favelas, protecting their turf through violence and patronage. By the early 1990s, the promise of the favela residents' mobilization of the late 1970s and early 1980s seemed out of reach. Yet the aspirations that fueled that mobilization have endured, and its legacy continues to shape favela politics in Rio de Janeiro.
