For too many years, the academic discipline of history has ignored American Indians or lacked the kind of open-minded thinking necessary to truly understand them. Most historians remain oriented toward the American experience at the expense of the Native experience. As a result, both the status and the quality of Native American history have suffered and remain marginalized within the discipline. In this impassioned work, noted historian Donald L. Fixico challenges academic historians—and everyone else—to change this way of thinking. Fixico argues that the current discipline and practice of American Indian history are insensitive to and inconsistent with Native people’s traditions, understandings, and ways of thinking about their own history. Questioning the Unquestionable to Think the Unthinkable and See the Invisible One thing that used to make me uncomfortable and bother me when I was growing up was that when I looked around almost everybody was like everybody else, doing what everybody was doing, making the same jokes, thinking thoughts that everybody was thinking, heading in the same direction; for example, I would see five small kiosks selling the same things on the same street. When someone started a business, a dozen others would start doing the same thing; my view was that everything looked to be at standstill, and I used to question this deep down in my heart and that still bothers me till today because nobody is supposed to be like nobody: I used to go to boarding school, stay, come back, and still find nothing has changed nothing different, no progress. In fact, it looked like things were moving backward; this used to depress me. Nothing changes in our life until we change. This does not mean that change cannot happen unless we do; there is a certain type of external change that happens even if we do not; for example, your body changes with or without your permission. Environment change is another example; however, unless we change things can never change in our lives. You see, if we keep on thinking the same thoughts doing the same things like the past generations did, we will not move forward but be at a standstill, and the problems with history repeating itself is that it teaches us what we have already seen and takes us to where we have already been and to see what we have seen.

In 2004, the U.S. Supreme Court held in Crawford v. Washington that testimonial hearsay is inadmissible at trial unless the declarant is available for cross-examination. Courts have subsequently struggled to define “testimonial hearsay,” but have often vaguely defined it as an out-of-court statement made for the primary purpose of establishing past events for use in future prosecution. Although Crawford intended to protect a defendant’s Sixth Amendment right to confrontation, in doing so, it overlooked the holding’s detrimental effects on two particular types of victims: domestic violence and rape victims. Under Crawford, domestic violence and rape victims’ out-of-court statements are likely to be considered testimonial because the sensitive and personal nature of these incidents often results in substantial deliberation prior to any declaration, as opposed to the impromptu declarations made during so-called ongoing emergencies. In turn, these statements are likely viewed as made for future prosecution. Moreover, domestic violence and rape victims have especially compelling and uniquely fragile psychological reasons to be unavailable for cross-examination, including being at risk at for re-traumatization. Yet, despite these reasons, Crawford still places pressure on these victims to be cross-examined in front of their perpetrators because testimonial hearsay evidence is often determinative in these types of trials, and thus an unavailable victim would lead to an increased likelihood of the perpetrator escaping conviction. This sensitivity and consequential unreliability surrounding the admissibility of testimonial hearsay upon which domestic violence and rape cases rely also disincentives prosecutors from pursuing these cases, further exacerbating the unlikelihood of conviction. To alleviate the detrimental impacts that Crawford has on both victims and trials, this Article suggests that Crawford’s essential terminology must be narrowly defined, exceptions to the ruling must be expanded upon, and victims must be adequately safeguarded.

The purpose of this book is to promote the value of translanguaging in EFL teaching contexts. To date, translanguaging has been discussed mostly in regards to US and European contexts. This book will examine the teaching beliefs and practices of teachers within a South Korean elementary school context to evaluate the practices of current teachers who use translanguaging strategies when teaching. This examination utilizes sociological theories of pedagogic discourse to discuss the consequences of language exclusion policies on the peninsula. Using these theories, it presents an argument for why EFL contexts like South Korea need to reevaluate their current policies and understandings of language learning and teaching. By embracing translanguaging as an approach, the author argues, they will transform their traditional notions of language learning and teaching in order to view teachers as bilinguals, and learners as emerging bilinguals, rather than use terms of deficiency that have traditionally been in place for such contexts. This book's unique use of sociological theories of pedagogic discourse supports a need to promote the translanguaging ideology of language teaching and learning.
