La presente edición ofrece la Ley 15/2009, de 11 de noviembre, del Contrato de Transporte Terrestre de Mercancías (BOE n.o 273, de 12 de noviembre de 2009), que entre en vigor el 12 de febrero de 2010 y que viene a sustituir básicamente a la anterior regulación establecida en el Código de Comercio de 1885, en la Ley de Ordenación de los Transportes Terrestres de 1987 y en su Reglamento de 1990. La nueva Ley regula por primera vez la responsabilidad por daños o pérdida de equipajes y la ampliación del plazo de prescripción de acciones de responsabilidad por daños personales a los viajeros. Igualmente, entre otras medidas, especifica con detalle todo lo relativo al acondicionamiento y entrega de mercancías y establece una normas específica para los servicios de paquetería y pequeños envíos.

Junto a ellos intervienen altos funcionarios del Ministerio de Fomento, protagonistas de excepción en el proceso de reforma que condujo a la Ley 15/2009. El Comentario, como su propio nombre indica, suministra una pauta general de seguimiento del nuevo texto legal y está destinado tanto a la práctica del derecho (abogados, jueces y magistrados) como a otros sectores directamente interesados en el transporte (aseguradoras y compañías de transporte). Por razones evidentes, la obra no contiene un apoyo doctrinal exhaustivo, aunque ello no quiere decir que se haya renunciado a la labor de investigación, sobre todo en aquellos preceptos que pueden ser objeto de especiales dificultades dogmáticas por la temática que abordan. Our response from our protected European standpoint, argues Slavoj Zizek, offers two versions of ideological blackmail: either we open our doors as widely as possible; or we try to pull up the drawbridge. Both solutions are bad, states Zizek. They merely prolong the problem, rather than tackling it. Maybe such solidarity is a utopia. But, warns Zizek, if we don't engage in it, then we are really lost. And we will deserve to be lost.
