Esta obra explora la relación entre el castigo y la determinación de la pena en los Estados Unidos a partir de un estudio en profundidad del sistema de penas determinadas mediante directrices: las United States Sentencing Guidelines. Al hilo de este estudio de las directrices, pionero en la literatura española y latinoamericana, se repasan los principales discursos sobre el castigo nacidos de la crisis de la resocialización, así como la problemática actual del encarcelamiento masivo y la pena capital para sumergirse de lleno en el estudio crítico y en detalle de los antecedentes directos de las Sentencing Guidelines, su andamiaje normativo y sus objetivos, la jurisprudencia al respecto de la Corte Suprema de los Estados Unidos y las principales críticas. La obra concluye con una reflexión sociológica sobre las Guidelines, el clasicismo y la modernidad penal, los criterios para uniformar las penas como modo de legitimación de prácticas punitivas y el papel de la justificación del castigo en un presente de sobrepoblación carcelaria.

The study of how the environment, local geography, and physical locations influence crime has a long history that stretches across a number of research traditions. These include the neighborhood-effects approach developed by the Chicago school of sociology in the 1920s; modern environmental criminology that explains the geographic distribution of crime; the criminology of place, which focuses on crime rates at specific places over time; and a newer approach that attends to the perception of crime and disorder in communities. Aided by new mobile and digital technologies as well as improved data reporting in recent decades, research in environmental criminology has developed at a rapid pace within each of these approaches.
