O VI Congresso de Direito da Insolvência, sob o título Entre Directivas, tinha em vista dois objectivos: em primeiro lugar, fazer o balanço da transposição da Directiva sobre reestruturação e insolvência pela Lei n.o 9/2022, de 11 de Janeiro; em segundo lugar, fazer a primeira avaliação da Proposta de Directiva de harmonização, que integra medidas revolucionárias como os processos pre-pack e um regime especial para a insolvência de microempresas. Os dois objectivos foram plenamente conseguidos. A discussão gerada no Congresso foi extraordinariamente participada e profunda, como demonstram o excepcional número de textos e a extensão final deste livro. Anunciando-se já uma terceira Directiva, o livro deve ser encarado como um símbolo daquilo que pode ser feito em Portugal para acompanhar, e até antecipar, os caminhos do Direito europeu e como um ponto de partida (um mote ou, simplesmente, uma inspiração) para mais discussões e discussões mais esclarecidas.

In an era of globalization and in an intellectual climate in which the idea of national sovereignty is under assault, Plattner identifies the essential features of modern liberal democracy and offers guidance about what is required to sustain it. This examination comes at a critical moment. After three decades of global advance, liberal democracy today is being challenged from many quarters. Among the reasons why its future looks cloudy is the popular election of candidates hostile to liberalism_in Palestine, Russia, Venezuela, and elsewhere. An investigation of the complex and tension-filled relationship between liberalism and majority rule is at the heart of this essential book. PlattnerOs contention is that liberalism needs democracy and that liberal democracy needs the nation-state. He argues that transnational bodies like the European Union cannot overcome their 'democratic deficit.' Hence he recommends an approach that will enable the United States to promote international cooperation without sacrificing the fundamental elements of national sovereignty or American democracy.

This book adopts a multidimensional approach to analyze both the historical and emerging factors that contribute to make Latin America and the Caribbean the most unequal region in the world. Social inequality is a historical characteristic of the region, but at the beginning of the 21st century, a handful of progressive governments seemed to be adopting policies that could reduce this historical trend. Many of these efforts, however, were blocked or reversed by the COVID-19 pandemic, which both exposed the persistence of historical trends and contributed to the emergency of new forms of inequality in the region. The different chapters in this contributed volume adopt a multidimensional, intersectional, perspective to analyze both the persistence and the emergency of social devices of production and reproduction of inequalities in the diverse Latin American and Caribbean temporal spatialities. The issues analyzed in the different chapters revolve around four main axes: a) persistence of generational and intergenerational inequalities; b) structural gender inequality; c) intertwined social inequalities: race, class and social structure and; c) historical and economic dimension of inequality. Persistence and Emergencies of Inequalities in Latin America: A Multidimensional Approach will be of interest to researchers interested in the study of social inequality and social justice in different fields of the human and social sciences, such as sociology, political science, history, economics, anthropology and education. There are now many features of a new world order: the circulation of concepts, techniques, rules; the development of global epistemic communities; an increasing mix of national and supranational institutions; the formation of more horizontal links among States, which do not disappear, but rather become accountable to one other; the generalization of common usages and rules. Overall, this is conventionally called globalization. Globalization is the major development in the field of public law in the second half of the twentieth century. It has evolved according to an incremental pattern. First, it was applied to peace and human rights (the United Nations); then, to areas such as the sea, nuclear waste, health, labor, the environment. Subsequently, it was applied to trade, and, finally, to global terrorism and global crises.
