Drawing on the 2016 update of the IMF’s Central Bank Legislation Database, this paper examines differences in central bank legal frameworks before and after the Global Financial Crisis. Examples from select countries show that many central bank laws have undergone changes in objectives, decision-making, accountability, and data collection. A wider cross-country survey illustrates the common occurrence of price stability in central bank objectives, and varying practices in defining financial stability, “independence” versus “autonomy,” and who within a central bank determines monetary policy. The highlighted facts illustrate the uses of the database and could be a starting point for further analyses.

The worldwide financial crisis revealed that some of the basic consensuses concerning the macroeconomic policy framework and the roles of the central banks were no longer tenable. This prompted rethinking of central bank objectives, strategies and policy instruments, with particular focus on the interactions between monetary and financial stability policies. This paper sheds some light on the flaws exposed during the crisis, debates within the academia and policy-making community and new evolving thinking about the roles and responsibilities of the central banks. The paper also reflects on the crisis' bearing on the roles and responsibilities of the National Bank of the Republic of North Macedonia. In the last decade, legal framework and operational practices were amended to strengthen financial stability mandate and macro prudential policy toolkit of the central bank, to enhance financial stability coordination among regulatory agencies, as well as to improve micro prudential supervision. To support monetary and financial policy decision making, statistical framework was significantly upgraded. Furthermore, given the importance for preserving financial stability, a focus was placed on financial education and consumer protection.

The respective legal frameworks that control central banks are shaped by whether they are market oriented or government controlled. However such stark distinction between these two categories has been challenged in view of the varying styles of crisis management demonstrated by different central banks during the crisis. This book uses comparative analysis to investigate how the global financial crisis challenged the role played by central banks in maintaining financial stability. Focusing on four central banks including the US Federal Reserve System, the Bank of England, the Bank of Japan and the People's Bank of China, it illustrates the similarities between the banks prior to the crisis, and their similar policy responses in the wake of the crisis. It demonstrates how each operated with varying levels of independence while performing very differently and facing different tasks. The book identifies some central explanatory variables for this behavior, addressing the mismatch of similar risk management solutions and varying outcomes.
