L’economia delle piattaforme ha reso possibile un nuovo sistema di consegne a domicilio basato su lavoro precario e poche tutele. I rider – i fattorini in bicicletta – rappresentano l’ultima frontiera della logistica nell’era dei mercati digitali: costretti a correre per ricevere una valutazione positiva dall’algoritmo che li controlla, sono pagati a consegna e tutti i loro movimenti sono tracciati in tempo reale. L’analisi di questo fenomeno esemplare è l’occasione per riflettere in maniera più ampia sui lavori di oggi e sui diritti dei lavoratori. Il problema lavorativo è generazionale ma non nuovo, mentre la quarta rivoluzione industriale ha tutt’al più accentuato gli effetti di un fenomeno già esistente e permesso di problematizzarlo. I giudici di tutto il mondo si sono dovuti confrontare con il fenomeno dei collaboratori delle piattaforme, conducendo Stati come la California, ma anche la Francia e l’Italia a introdurre delle leggi speciali per tutelarli. La soluzione, per mano legislativa, del problema dei rider rischia tuttavia di essere solo un palliativo, forse mediaticamente efficace ma dai risvolti concreti molto limitati: un nuovo statuto del Lavoro sembra necessario per reagire all’incapacità – o, forse, all’impossibilità – di riconoscere nel lavoro 4.0 i connotati della subordinazione e nella subordinazione “tradizionale” il paradigma lavorativo dei nostri giorni.
