The modern public prosecutor is a figure both powerful and enigmatic. Legal scholars and criminologists often identify “three essential components” of criminal justice systems: police, courts and corrections. Yet increasingly, the public prosecutor occupies a distinct role independent from any of these branches. Acting outside of the court, and therefore largely out of the public eye, the prosecutor’s control over whether and what charges proceed to court can limit judicial discretion on sentencing, open pathways to alternative measures and even deny entry into the criminal justice system entirely. In this sense the prosecutor serves as a true “gatekeeper” to the criminal process. This book addresses key aspects of the evolving role of domestic and international prosecutors in common law and civil law systems in the twenty-first century, and the challenges posed by this evolution. This collection of chapters from respected scholars takes an international, comparative approach and explores how these different legal systems have borrowed theorisations and articulations of the prosecutorial role from each other in adapting the office to changing conditions and expectations. Conversations surrounding the reform or even abolition of the criminal legal system have been circulating for decades. Legislation has aimed to change the way society thinks about and implements sentencing, detention, incarceration, policing, and the other various carceral strategies we use to "keep peace" in our communities, but none have been able to overhaul the practices that bring a defendant before the court. This project studies how prosecutors wield authority over the criminal legal system in a way that no other person can through the eyes of former federal and former state prosecutors. I analyzed qualitative data by collecting interviews with attorneys who, at one point in their career, represented the government - state or federal - in criminal proceedings. Prosecutors were found to be motivated in their decision making through three different elements: their identity, the belief that "good" or "sound" judgment was imperative to the job, and the more overarching concept that prosecutors are held to a higher moral and ethical standard than other lawyers. In addition, prosecutors were overwhelmingly found to hold opinions that the system could be reformed in some way, and their proposed reforms typically promoted the expansion of the current criminal legal system.
