Dans la foulée de la reconnaissance comme « sujets de droits » des fleuves Whanganui en Nouvelle-Zélande, du Gange et Yamuna en Inde, de la rivière Yarra en Australie et de l’Atrato en Colombie, l’Observatoire international des droits de la Nature a initié une réflexion sur la possibilité de reconnaître le Fleuve Saint-Laurent, ce « chemin qui marche » comme le nomment les Premières Nations, comme « personne juridique ». Les textes du présent ouvrage collectif portent sur les implications de l’attribution d’une personnalité juridique et de droits au Fleuve Saint-Laurent, approfondissent les fondements épistémologiques du paradigme de la reconnaissance des droits de la Nature et présentent des cas concrets des reconnaissances de fleuves comme sujets de droit. Rédigés par des experts et expertes originaires de plusieurs pays où la reconnaissance d’une personnalité juridique des fleuves s’est produite à ce jour, ils posent un regard approfondi sur les défis et apports de ce changement de paradigme sur la protection des fleuves. Le présent ouvrage vient répondre aux interrogations des implications d’une telle reconnaissance et contribue au processus de construction d’un nouveau droit qui vient de s’amorcer au Québec et au Canada avec l’adoption en février 2021 de résolutions conférant le statut de « personne juridique » à la rivière MagPie/Muteshekau Shipu située sur la Côte-nord du Québec et sur le Nitassinan (territoire ancestral) de deux communautés innue, Ekuanitshit et Uashat mak Mani-utemam.

The mobilisation centred on the 2015 Paris Climate Conference (COP 21) is an opportunity to highlight the vulnerability of environments and populations in the South in the face of climate warming. Some tropical regions are already suffering from its effects, with heat waves in the Sahel, disturbances to monsoon systems, the melting of the Andean glaciers, threats to biodiversity, a rise in sea level and other features.
