The Law Library presents the complete text of the Establishment of Marine Reserves and a Marine Conservation Area Within the Channel Islands National Marine Sanctuary (US National Oceanic and Atmospheric Administration Regulation) (NOAA) (2018 Edition). Updated as of May 29, 2018 On August 11, 2006 NOAA issued a notice of proposed rulemaking to establish a network of marine zones within the state and federal waters of the Channel Islands National Marine Sanctuary (CINMS or Sanctuary). State waters in the Sanctuary extend from the shoreline of the islands to approximately 3 nautical miles from shore. Federal waters of the Sanctuary extend from the offshore extent of state waters to the Sanctuary's outer boundary. In this final rule, NOAA is issuing final regulations for the federal-waters portion of the Sanctuary. NOAA has decided to defer a final decision and seeking additional comment on the state-waters portion of the Sanctuary pending action by the State of California to extend the boundaries of several existing state-waters zones to the three mile state-federal-waters boundary. This study also examines the spectrum of heterogeneous recreational users of the Channel Islands, proposing a methodology to measure the economic value of marine reserves on heterogeneous user populations in which a portion of the population may participate in consumptive activities while others participate exclusively in non-consumptive activities. Users were split into three unique user groups which were hypothesized to hold different preferences and values for no-take marine reserves: strictly non-consumptive users, mixed users who participate in both consumptive and non-consumptive activities, and recreational "fishing priority users" whose primary reason for traveling to the Channel Islands is to fish. Non-parametric mean welfare estimates were calculated for each of these three user groups.

In 2003, twelve marine protected areas were established in state waters (0-3 nmi) surrounding the Channel Islands. NOAA is considering extending this network (3-6 nmi) into deeper waters of the Channel Islands National Marine Sanctuary (CINMS). In order for effective long-term management of the deep water reserves to occur, a well-structured monitoring program is required to assess effectiveness. The CINMS and the National Marine Sanctuary Program (NMSP) hosted a 2-day workshop in April 2005 to develop a monitoring plan for the proposed federal marine reserves in that sanctuary. Conducted at the University of California at Santa Barbara, participants included scientists from academic, state, federal, and private research institutions. Workshop participants developed project ideas that could answer priority questions posed by the NMSP. This workshop report will be used to develop a monitoring plan for the reserves.
