Children are often necessary witnesses in court proceedings. This may be as witnesses to crime, or to domestic violence in the home, where children may be the only witnesses other than the victim. As victims themselves, children may be called upon to testify in physical abuse or sexual abuse situations against defendants accused of the acts. Even in civil proceedings children may be essential. Children are often necessary witnesses in court proceedings. This may be witnesses as to events they observed. And, in dependency proceedings where children have been taken into foster care by a state agency, the child may be an appropriate witness in various stages of the abuse and neglect proceeding. In fact, federal law mandates the presence of the child in some proceedings unless excused by the court. Furthermore, it is not unusual in custody and visitation proceedings for one (or even both) parents to attempt to present a child's testimony, especially where the child is able to state a preference as to which parent should be granted custody or what visitation is appropriate. Judges struggle with a number of important issues when children are called as witnesses in the courtroom in these situations. Courts must be aware of the psycho-social effects of children being drawn into court proceedings and be sensitive to the special needs of children in these stressful situations. The competency and reliability of the testimony may be challenged and in criminal proceedings the right of confrontation must be honored. Expert witnesses may be called to offer testimony regarding the ability of children to recall events and on issues such as delay in disclosure of abuse, recantation and suggestibility. A review of the basic challenges facing courts suggests some common approaches that may guide judges in these situations.
