This thesis examines mediation as a means of dispute resolution in the Church of England as an alternative to recourse to the courts, whether civil or ecclesiastical. -- The introduction considers the subject from the point of view of scriptural authority, before outlining certain historical and legal influences, channelling its practice from the Early Church to modern times. A theory is posited that whilst the fons et origo of mediation cannot be directly attributed to created human nature, a correlation can be observed between compromise emanating merely from the ethical dimension of humanism, and that from divinely inspired religious tradition. -- Chapter 2 identifies the methodology selected, reflecting the particular reasons for the choice of Questionnaire. The topics were designed to answer four questions: first, whether there remains a substantial theological dimension to the application of mediation in the Church; second, what challenges, occasioned by social and religious changes in the past decade, need now to be met: thirdly, what new directions might foster dedicated training in the subject, and whether this should take place before or after ordination, or pursued as part of continuing professional development. Fourthly, are considered any necessary steps to engender the wider knowledge and use of mediation by those with whom the Church becomes engaged. -- Chapter 3 contains the results of a survey of the present position. All 104 Archdeacons in post in the Church of England were consulted, from whom 32 of the 43 dioceses (74.4%) responded. -- The discussion, looking to a number of parallel models, and the conclusions which follow, reflect that mediation retains a valued theological dimension extending beyond its secular benefits of cost, time or unwarranted publicity.
