In 1963, Howard S. Becker gave a lecture about deviance, challenging the then-conventional definition that deviance was inherently criminal and abnormal and arguing that instead, deviance was better understood as a function of labeling. At the end of his lecture, a distinguished colleague standing at the back of the room, puffing a cigar, looked at Becker quizzically and asked, “What about murder? Isn’t that really deviant?” It sounded like Becker had been backed into a corner. Becker, however, wasn’t defeated! Reasonable people, he countered, differ over whether certain killings are murder or justified homicide, and these differences vary depending on what kinds of people did the killing. In What About Mozart? What About Murder?, Becker uses this example, along with many others, to demonstrate the different ways to study society, one that uses carefully investigated, specific cases and another that relies on speculation and on what he calls “killer questions,” aimed at taking down an opponent by citing invented cases. A total institution is defined by Goffman as a place of residence and work where a large number of like-situated, individuals, cut off from the wider society for an appreciable period of time, together lead an enclosed, formally administered round of life. Prisons serve as a clear example, providing we appreciate that what is prison-like about prisons is found in institutions whose members have broken no laws. This volume deals with total institutions in general and, mental hospitals, in particular. The main focus is, on the world of the inmate, not the world of the staff. A chief concern is to develop a sociological version of the structure of the self. Each of the essays in this book were intended to focus on the same issue--the inmate's situation in an institutional context. Each chapter approaches the central issue from a different vantage point, each introduction drawing upon a different source in sociology and having little direct relation to the other chapters. This method of presenting material may be irksome, but it allows the reader to pursue the main theme of each paper analytically and comparatively past the point that would be allowable in chapters of an integrated book. If sociological concepts are to be treated with affection, each must be traced back to where it best applies, followed from there wherever it seems to lead, and pressed to disclose the rest of its family.

Sobre a obra Reparação e Prevenção de Danos na Responsabilidade Civil - 1a Ed – 2024 Parâmetros para o Ressarcimento de Despesas Preventivas "A obra aponta a prevenção de danos como um desses possíveis valores, cuja promoção se defende por um viés tão sutil quanto auspicioso: a indenizabilidade de despesas preventivas realizadas pela vítima e a possível influência que tais despesas podem surtir sobre o quantum indenizatório quando realizadas pelo causador do dano. A abordagem é promissora, na medida em que detecta na prevenção, não um dever exigível das partes pela via estrita da responsabilidade civil (o que apenas poderia ocorrer por expressa deliberação legislativa e, preferencialmente, mediante instrumentos mais específicos que o dever de indenizar), mas sim um valor que se busca promover e tutelar no momento da identificação e quantificação do dano injusto. Como afirmado anteriormente, a injustiça do dano (e sua consequente indenizabilidade), em perspectiva valorativa e funcional, não deixa de traduzir um juízo de merecimento de tutela sobre os interesses em jogo na fattispecie danosa.
