The book examines in detail one of the most controversial topic in current international law, namely the scope and extent of the right of individual self-defense. The book carefully traces the paths which have been followed in the developing legal debate on self-defense. The author uses numerous case-studies of incidents involving the use of force in alleged self-defense (such as the Entebbe Incident 1976, the Nicaragua Case 1986 or the Israeli-Lebanese conflict of 2006) which have formed the central point of scholarly debate. The author's conclusions are based not only on thorough analysis of academic discussions but also of the practice of States and international bodies, especially of the United Nations Organization. At the outset of the book the author reviews the historical context and the customary evolution of the right of self-defense. Reference is made to the famous Caroline Case of 1837, which set the necessary conditions of lawful exercise of self-defense. Next, the author examines the concept and legal nature of self-defense, carefully assessing the customary conditions of necessity, proportionality and immediacy derived from the Caroline Case. As the occurrence of an "armed attack" is a conditio sine qua non of lawful invocation of self-defense, several modalities of an armed attack are attentively evaluated such as its constituent elements, beginning or scale. The author explores, whether reactions to acts of international terrorism committed by a non-State may be based on the right of self-defense. In times of global terrorist networks it is highly desirable to attach special attention to use of force in self-defense as a remedy against serious acts of terrorism. Thorough analysis of State practice is shown on several examples from recent history - the U.S. air raid on Libya in 1986 and on Baghdad in 1993 and relatively recent air strikes on Sudan and Afghanistan in 1998. Reference is also made to the most striking example - the Al-Qaeda attack on the United States in 2001. The validity of claims of anticipatory/preventive self-defense is examined on a theoretical level and then applied to the specific details of the Israeli air strike on the Osiraq Nuclear Reactor in 1981. The two main approaches to preventive self-defense - "restrictive" and "traditional" - are then discussed in detail. Brief analysis is also devoted to the nature of the so-called - pre-emptive - self-defense indicating its current position under international law.

This study deals with the collective roles that civilians come to play in the context of civil war. Concretely, it documents and analyzes a little studied pattern of civilian agency: civilian noncooperation with armed groups. It develops a theory that specifies where and when civilians are more likely to organize themselves to refuse non-violently to cooperate with armed organizations. Where territorial control is shifting, where violence against civilians has recently spiked, and where targeting is perceived as unavoidable, a desire for noncooperation is likely to evolve. However, this desire is not enough for us to observe organized noncooperation. Campaigns of noncooperation are likely to emerge when desire meets capacity for collective action. Localities with a prior history of mobilization and/or with the support of external actors are more likely to count on the leadership and the associational space needed for organizing action. These conditions are found to be individually necessary and jointly sufficient across three different ideal types of noncooperation: oblique, pacted and unilateral. Complementing this set of expectations, the study specifies a limited number of cognitive and relational mechanisms that explain the pathway towards noncooperation. Civilian noncooperation is proposed both as a strategy of community self-protection and a form of contentious politics. In this sense, the study bridges scholarship on the micro-dynamics of civil war, civil resistance, social movements/collective action and civilian protection. The analysis is embedded in a three-stage research design that combines within-case analysis, cross-case structured and focused comparisons, and paired comparisons of positive and control observations. The empirical data, both qualitative and quantitative, was gathered during two separate waves of field research in warzones using different techniques of data collection. These included over 150 individual and group interviews with civilians and (ex)combatants, memory workshops, collective map-drawing and timeline-building exercises, and direct observation. The goal of this study is accomplished to the extent that it succeeds in the art of combining parsimonious theorization of an outcome with the smells and sounds of the complex processes that give life to that outcome. In other words, providing sensitive simplification and empirically falsifiable claims is as important as offering a realistic and fair account of the lives of the communities I lived and worked with over the past years. Ultimately, it is for the reader to judge.

This book examines the emergent conviction that UN robust peacekeeping works better than UN traditional peacekeeping in reducing civilian killings within contemporary post-cold war violent civil wars. In an unprecedented study, Nsia-Pepra has systematically and empirically documented the relationship between robust peacekeeping and civilian killings in violent civil wars using both statistical and case study models. His research, engagingly expounded upon in UN Robust Peacekeeping, indicates that robust peacekeeping works better than traditional peacekeeping in lowering civilian killings by spoilers in violent civil wars. His book also presents the concept of a formidable barrier model of robust peacekeeping success using the game theoretical model. It makes policy recommendations to enhance the UN's capacity to protect civilians from human rights violations, including a unified, coherent doctrinal definition for robust peacekeeping, an operational doctrine on the use of force, and improved UN intelligence capacity. Nsia-Pepra also suggests employing the GA 1950 Uniting for Peace Resolution as well as robust mandates, common training doctrine, pre-deployment training, improved UN intelligence capacity, major power participation, implementation of R2P and US objective global leadership.

This book explores the issue of civilian devastation in modern warfare, focusing on the complex processes that effectively establish civilians’ identity in times of war. Underpinning the physicality of war’s tumult are structural forces that create landscapes of civilian vulnerability.
