Entré en vigueur le 1er janvier 1900, le code civil allemand, Bürgerliches Gesetzbuch (BGB), a été alors salué comme l'oeuvre " la plus considérable de son époque. Les qualités formelles de ce code et la technique législative mise en oeuvre ont retenu l'attention au point qu'une première traduction commentée en français a été très vite entreprise. Après 1945, la loi fondamentale du 23 mai 1949 a consacré des droits nouveaux emportant de nombreuses réformes législatives. Cette évolution du droit a justifié une nouvelle traduction du BGB (et du code de commerce) au début des années soixante-dix. Les transpositions des directives européennes restées d'abord en dehors du BGB, ont été intégrées par la loi du 26 novembre 2001 dite de modernisation des obligations qui a restauré " l'unité du droit civil patrimonial " et donné une nouvelle jeunesse au code. Cette vitalité justifiait qu'une nouvelle traduction assortie de commentaires soit réalisée. Oeuvre d'universitaires, grands connaisseurs du droit allemand, cette traduction entend conserver les traits permettant au lecteur de rattacher sans équivoque le texte traduit au système juridique allemand. Le commentaire proposé consiste en des notices introductives de chaque grande division thématique du code. Chacun mesure le profit qu'il peut y avoir à favoriser l'accès des juristes francophones à ce monument de l'histoire de la codification. Ils trouveront un intérêt tout particulier à la lecture des textes relatifs au droit des obligations en un temps où l'on cherche à dégager un droit commun des contrats au sein de l'Union européenne.
