This volume of the "Yearbook of the European Convention on Human Rights, prepared by the Directorate of Human Rights of the Council of Europe, relates to 2003. Part one contains information on the Convention. Part two deals with the control mechanism of the European Convention on Human Rights: selected judgments of the European Court of Human Rights and human rights (DH) resolutions of the Committee of Ministers; part three groups together the other work of the Council of Europe in the field of human rights, and includes the work of the Committee of Ministers, the Parliamentary Assembly and the Directorate General of Human Rights; part four is devoted to information on national legislation and extracts from national judicial decisions concerning rights protected by the Convention. The Committee of Ministers of the Couneil of Europe by a Re solution of 6th February 1960, authorised the publication of a Yearbook of the European Convention on Human Rights. The Yearbook, the first volume of which appeared in 1959 under the title "European Commission of Human Rights - Documents and Decisions", will in future be published each year in the month of September. The Yearbook, being prepared by the Directorate of Human Rights of the Council of Europe, does not involve the responsibility either of the European Commission or of the European Court of Human Rights. In partieular, the summaries of the decisions of the European Commission of Human Rights eannot be quoted against the actual texts of the decisions eontained in the first and second volumes. Cet ouvrage est consacré à l’examen de questions touchant à la pénétration du droit international et européen des droits de l’homme dans l’ordre juridique belge et au statut « formel » que le juge national entend lui reconnaître. Ces questions, regroupées par thèmes et sous-thèmes, sont pour certaines d’entre elles très classiques. Elles tiennent notamment : • à l’effet direct reconnu, ou non, à tel ou tel instrument de protection des droits de l’homme ; • au rang qui est le sien dans la hiérarchie des normes et à la qualité d’ « ordre public » qui lui est éventuellement associée ; • ou encore aux perspectives qu’offre le droit de la responsabilité civile aux victimes d’un manquement à ses prescrits. D’autres questions sont plus neuves : elles concernent par exemple le partage délicat des responsabilités juridictionnelles dans la mission de protection du droit international et européen des droits de l’homme face à la loi, mais aussi l’accueil réservé par nos juridictions à la soft law et à la soft jurisprudence, sans cesse plus abondantes, que charrie ce corpus juris. Les thèmes et sous-thèmes ainsi répertoriés sont analysés sous la forme de substantiels commentaires de « Grands Arrêts » jugés emblématiques, issus essentiellement de la Cour de cassation, du Conseil d’État ou de la Cour constitutionnelle. Là où les questions étudiées le justifient, la sélection opérée s’autorise des détours par Luxembourg, Strasbourg, et même La Haye. Par ailleurs, les « observations » dont chacune des décisions reproduites fait l’objet, consacrent l’attention qu’ils méritent aux avis de la Section de législation du Conseil d’État. L’ouvrage s’adresse à celles et ceux qui, au barreau, dans la magistrature ou à l’université, entendent ouvrir leur horizon et/ou approfondir leurs connaissances sur le droit international et européen des droits de l’homme.
