L’opera costituisce una novità nel panorama delle pubblicazioni giuridiche italiane perché, nell’affrontare lo studio sistematico degli istituti di diritto industriale, riporta all’interno di ogni capitolo i pertinenti riferimenti normativi associando l’inquadramento dottrinale e giurisprudenziale al testo del Codice. Sono approfondite le tematiche di diritto sostanziale, procedimentale e processuale che contrassegnano il settore della P.I. con particolare riguardo sia all’apporto giurisprudenziale delle Corti di merito e di legittimità sia agli aspetti di allineamento agli impegni europei ed internazionali che il legislatore ha inteso perseguire e che l’interprete è in ogni caso tenuto a privilegiare. Costante è il riferimento al diritto UE, ai trattati internazionali, ai principi desunti in via comparata dagli ordinamenti dei paesi industrialmente più avanzati. L’opera si propone di fornire un ausilio tecnico-giuridico il più possibile aggiornato, partendo dal testo base (Dlgs 10 febbraio 2005 n.30) come da ultimo revisionato dal c.d decreto correttivo (Dlgs 13 agosto 2010 n.131) ed integrato dal Regolamento di attuazione (D.M.13 gennaio 2010 n.33), approfondendo l’esegesi dei vari istituti via via delineati con nessi e corrispondenze tra i relativi articoli, recependo e raffrontando i risultati dell’evoluzione normativa europea che da tempo si riflettono sul sistema nazionale e presto influiranno anche sull’ordinamento processuale interno (per la prevista istituzione di una Unitary Patent Court chiamata a gestire il futuro brevetto europeo con effetto unitario). I volumi – tematicamente suddivisi in quattro parti - si chiudono con un appendice legislativa che riporta il testo del Codice e del Regolamento di attuazione e vi è affiancato un indice analitico che rimanda, per ciascun articolo, ai corrispondenti capitoli e sezioni di riferimento. STRUTTURA L'opera è divisa in due tomi. Il primo tomo si occupa del diritto sostanziale, il secondo tomo del diritto procedimentale e processuale. Ogni tomo è suddiviso in parti formate da capitoli in alcuni casi divisi in sezioni. Ampio apparato di note al piede. Appendice legislativa contenente il testo del: D.lgs. 10 febbraio 2005 n. 30 (Codice della proprietà industriale) Decreto 13 gennaio 2010 n. 33 (Regolamento di attuazione del codice della proprietà industriale). Chiude l'opera un indice analitico che rimanda, per ciascun articolo, ai corrispondenti capitoli e sezioni di riferimento.
