Thank you. " Although the mother of the killed girl described the story in tears, on July 6, 2018, the Chiba District Court sentenced the murderer, Shibuya, to life imprisonment. Shibuya, who has always been innocent, appealed immediately. Lei Ling, a family of four with her parents and younger brother, moved from Kawasaki to Matsudo in December 2015. At 8 am on March 24, 2017, Lei Ling went out to participate in the third-year primary school closing ceremony, but did not appear at the Matsudo City Liushi Second Elementary School. The school asked Lei Ling's father, who asked the police for a search. The police took over the investigation. The surveillance camera of Lei Ling's house captured the picture of Lei Ling walking to school alone wearing a yellow hat and a red schoolbag. Multiple shots on the way to school did not record Lei Ling's figure. Volunteer parents responsible for maintaining traffic order during the school rush hour near the school said they did not see Lei Ling coming to school. At 6:45 a.m. on March 26, 12 kilometers away from Lei Ling's residence, under a bridge in Beixintian, ABIKO, a fisherman found the body of a naked girl with a bleeding body on his mouth next to a drainage channel. She was beaten, and her neck was scratched. The fisherman called the police and the police arrived to investigate and confirmed that the deceased was Lei Ling, who disappeared two days ago. The next day, the forensic doctor dissected the body, believing that Lei Ling might have died of suffocation. The forensic doctor said that although the eye could not confirm whether there was semen on the corpse, the genitals of the deceased were hurted she was believed to have been sexually assaulted. The forensic doctor subsequently found semen in the deceased. About 18 kilometers away from the scene where the body was found, Lei Ling's schoolbag was found by the Tonegawa River in Banto, Ibaraki Prefecture. On March 28, Lei Ling's clothes were found by the river about 500 meters away from the scene where the body was found. The Chiba Prefecture Police set up an investigation headquarters to publish photos of the girl killed, and called on all sectors of the community to provide clues. Lei Ling's father said in an interview with the media, "I hope that the media will use real names to report instead of using pseudonyms or anonymity, so that the facts can be communicated to the public." Lei Ling's father said that everyone know what happened to his daughter, hoping that the law can make the truth come to light and the killer should receive the punishment he deserves.

Shibuya (47 years old) has a son and a daughter with his wife, and his family is harmonious. Shibuya's grandparents were engaged in the transportation industry and left an asset. The apartment where he lives is a four-story building under his own name. The first floor is rented to a convenience store, and the remaining three-storey apartments are rented out. The estimated monthly rent income is about 800,000 yen. Shibuya reported that the current real estate practitioner began serving as the president of the Parent Association of Matsudo City Sixth Elementary School in 2016. Lei Ling was studying at the school, and the Shibuya family was about 300 meters away from the girl's family. Shibuya often volunteers to maintain traffic safety during school hours. Forensic officers detected Lei Ling's blood stains in various places on the car. Police believe that Shibuya locked Lei Ling in the car with handcuffs prepared in advance and strangled the girl after sexually assaulting her. It is believed that she was killed within five hours of being abducted. Shibuya drove out and stepped on from evening to night, discarding Lei Ling's clothes, school bags and other personal belongings. Before 6:45 am on March 26, Shibuya discarded the body in a drainage ditch in ABIKO. Shibuya's DNA is consistent with the evidence collected at the crime scene. On May 5, the Japanese police announced that in addition to the crime of abandoning the body, Shibuya was also suspected of carrying out an abduction for the purpose of indecent assault, which resulted in the death of the victim during the forced indecent process. It was decided to arrest Shibuya, the suspect, again for murder, abduction and forcible death. Police revealed at a press conference that after Shibuya's arrest, he remained silent and was unwilling to explain the case. On June 4, 2018, the referee trial began in Chiba District Court. Shibuya claimed that "the content of the prosecution was fabricated out of thin air, and I have nothing to do with the incident." After his arrest, he insisted on keeping silent, and always maintained innocence during the trial. The prosecutor stated in his case that the defendant Shibuya drove the girl Lei Ling in a light-duty private car at that time, and then insulted her by some means to suffocate and kill her. The corpse was abandoned in the grass in the ABIKO of the county. The prosecution pointed out that the blood collected on the floor of the defendant's light private car matched the DNA of the girl. The defendant's DNA was also found on the remains of the body, confirming that he had forcibly taken Lei Ling and was planning a crime, and the prosecutor sought a death sentence from the judge. The defense stated that the incident was being reported so extensively that the search agency was under strong pressure, and that the DNA of the defendant Shibuya could be used as a prisoner to identify. The blood found in the car may have been left by the girl when she hitchhiked before the incident, there was no defendant footprint at the scene of the corpse, which was also very unnatural. On July 6, 2018, the Chiba District Court ruled on the case. The court has 65 auditoriums, and the number of attendees today reached 327. The Chief Justice Nohara said that there was sufficient evidence that Shibuya killed and raped Lei Ling, who was only nine years old, and his crime was unforgivable. He was sentenced to life imprisonment. Tokugawa Japan ranks with ancient Athens as a society that not only tolerated, but celebrated, male homosexual behavior. Few scholars have seriously studied the subject, and until now none have satisfactorily explained the origins of the tradition or elucidated how its conventions reflected class structure and gender roles. Gary P. Leupp fills the gap with a dynamic examination of the origins and nature of the tradition. Based on a wealth of literary and historical documentation, this study places Tokugawa homosexuality in a global context, exploring its implications for contemporary debates on the historical construction of sexual desire. Combing through popular fiction, law codes, religious works, medical treatises, biographical material, and artistic treatments, Leupp traces the origins of pre-Tokugawa homosexual traditions among monks and samurai, then describes the emergence of homosexual practices among commoners in Tokugawa cities. He argues that it was "nurture" rather than "nature" that accounted for such conspicuous male/male sexuality and that bisexuality was more prevalent than homosexuality. Detailed, thorough, and very readable, this study is the first in English or Japanese to address so comprehensively one of the most complex and intriguing aspects of Japanese history.

Seventy years have passed since the end of the Asia-Pacific War, yet Japan remains embroiled in controversy with its neighbors over the war’s commemoration. Among the many points of contention between Japan, China, and South Korea are interpretations of the Tokyo War Crimes Trial, apologies and compensation for foreign victims of Japanese aggression, prime ministerial visits to the Yasukuni Shrine, and the war’s portrayal in textbooks. Collectively, these controversies have come to be called the “history problem.” But why has the problem become so intractable? Can it ever be resolved, and if so, how? To answer these questions author Hiro Saito mobilizes the sociology of collective memory and social movements, political theories of apology and reconciliation, psychological research on intergroup conflict, and philosophical reflections on memory and history. The history problem, he argues, is essentially a relational phenomenon caused when nations publicly showcase self-serving versions of the past at key ceremonies and events: Japan, South Korea, and China all focus on what happened to their own citizens with little regard for foreign others. Saito goes on to explore the emergence of a cosmopolitan form of commemoration taking humanity, rather than nationality, as its primary frame of reference, an approach increasingly used by a transnational network of advocacy NGOs, victims of Japan’s past wrongdoings, historians, and educators. When cosmopolitan commemoration is practiced as a collective endeavor by both perpetrators and victims, Saito argues, a resolution of the history problem—and eventual reconciliation—will finally become possible. The History Problem examines a vast corpus of historical material in both English and Japanese, offering provocative findings that challenge orthodox explanations. Between 1944 and 1949 the United States Navy held a war crimes tribunal that tried Japanese nationals and members of Guam's indigenous Chamorro population who had worked for Japan's military government. In Sacred Men Keith L. Camacho traces the tribunal's legacy and its role in shaping contemporary domestic and international laws regarding combatants, jurisdiction, and property. Drawing on Giorgio Agamben's notions of bare life and Chamorro concepts of retribution, Camacho demonstrates how the U.S. tribunal used and justified the imprisonment, torture, murder, and exiling of accused Japanese and Chamorro war criminals in order to institute a new American political order. This U.S. disciplinary logic in Guam, Camacho argues, continues to directly inform the ideology used to justify the Guantánamo Bay detention center, the torture and enhanced interrogation of enemy combatants, and the American carceral state.

This open access book provides a comparative perspective on capital punishment in Japan and the United States. Alongside the US, Japan is one of only a few developed democracies in the world which retains capital punishment and continues to carry out executions on a regular basis. There are some similarities between the two systems of capital punishment but there are also many striking differences. These include differences in capital jurisprudence, execution method, the nature and extent of secrecy surrounding death penalty deliberations and executions, institutional capacities to prevent and discover wrongful convictions, orientations to lay participation and to victim participation, and orientations to “democracy” and governance. Johnson also explores several fundamental issues about the ultimate criminal penalty, such as the proper role of citizen preferences in governing a system of punishment and the relevance of the feelings of victims and survivors.
