The concept of common law has been one of the most important conceptual instruments of the western legal tradition, but it has been neglected by legal theory and legal history for the last two centuries. There were many common laws in Europe, including what is known in English as the common law, yet they have never previously been studied as a general phenomenon. Until the nineteenth century, the common laws of Europe lived in constant interaction with the particular laws which prevailedin their territories, and with one another. Common law was the main instrument of conciliation of laws which were drawn from different sources, though applicable on a given territory. Claims of universality could be, and were, reconciled with claims of particularity. Nineteenth and twentieth century legal theory taught that law was the exclusive product of the state, yet common laws continued to function on a world-wide basis throughout the entire period of legal nationalism. As national legal exclusivity is increasingly challenged by the process of globalization, the concept of common law can be looked to once again as a means of conceptualisation and justification of law beyond the state, while still supporting state and other local forms of normativity.

The Rise Of Business Ethics written by Bernard Mees and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-11-28 with Business & Economics categories.

In 1973, Daniel Bell argued that corporations in post-industrial societies increasingly needed to behave in accord with widely accepted social norms, particularly in terms of ethical behavior and social responsibility. Yet widespread criticism of business behavior was not an invention of the 1960s and 70s or a product of changing commercial norms. The key feature historically has been business scandal. Understandings of how the field of business ethics has emerged are undeveloped, however. This book is the first attempt to explain the conditions which saw a focus develop on business ethics especially in the 1960s and 70s, and how the broader field developed to encompass related notions such as corporate governance, corporate social responsibility, ethical leadership, sustainable business and responsible management education. The Rise of Business Ethics provides an introduction and analysis of the key developments in contemporary business ethics by examining them in terms of their diachronic development – the key thinkers, the key issues, the key institutions and how they each contributed to contemporary understandings of business ethics, governance and practice. Addressing the topic from a European as well as North American perspective, The Rise of Business Ethics will be of interest to researchers, academics, and students in the fields of business ethics, business and society, business history, organization studies and political economy.

This book is intended to serve as a guide to businessmen and their advisers, either from outside the Common Market or from within, who seek basic information on questions in three main fields: company law and related legal matters, taxation, and labour law. For those who wish to establish an enter prise or form a holding or financing company in one of the Member States of the Common Market (including Greece, of course) or Switzerland this guide offers a unique opportunity to compare conditions in the various countries in the three fields. This is facilitated by the strict adherence to one format for each national chapter. Those who are already present in one or more of the eleven countries will find a global answer to a number of practical questions that may arise. For detailed answers the local lawyer or other consultant remains indispensable. The format is based on two different approaches the foreign investor may take: either he 'goes it alone', by way of establishing a branch, setting up a subsidiary or taking over an existing company, or he joins forces with another investor from within the host country or from outside. In the latter event there are a number of legal forms (jointly owned company, partnership, etc. ) which may be used.
