Excerpt from Commentaries on the Laws of England, Vol. 1: In Four Books; Together With Such Notes of Enduring Value as Have Been Published in the Several English Editions; Including Books I and II It is not our meaning that the student should read history with a view alone to the law, or that he should confine his investigations to the history of a single race: in this particular his culture cannot be too broad or too liberal; what we mean is, that to the lawyer English history possesses a value that renders its careful study quite indispensable, and that the student of law must pursue it as the beginning and foundation of his legal course if he aspires to respectable attainments. His particular and careful attention should be directed to the history of the English constitution as traced in the works of writers like Hallam and May; and from the speeches of Burke and Erskine, and other eminent statemen of modern times, as well as from some of the leading state trials, he will derive abundant illustration of a fiertinent and forcible character, that will tend to make more vivid and permanent the impression which the facts of the history leave upon the mind.(b) About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Commentaries on the Laws of England of Sir William Blackstone, Vol. 1 In the preparation of this Edition of Sir William Blackstone's Commentaries, the same rule has been followed as in the first revision of the Work by the present Editor. He has altered the text, where the text required or seemed to require alteration; but he has in no case omitted anything which could usefully be retained. He may have preserved much which is of antiquarian interest only; but, if so, this will, he hopes, be esteemed an error in the right direction. He can repeat confidently the statement he made in reference to his first attempt to adapt the Commentaries to the present state of the Law - that no trouble or labour has been wanting on his part to fulfil properly the responsible duty he has undertaken. The Commentaries on the Laws of England was a four volume set intended to bring England's common law into a realm of understanding for the average citizen. The second volume, presented here, details the rights of 'things'. Blackstone's work was credited as being the first since the Middle Ages to methodically examine the laws of England. His work is credited with helping to lay the foundation for the American legal system. This volume examines the laws surrounding property and ownership. It is the longest volume of the set, and deals extensively with real property as well as chattel property. The work is presented without an introduction, but is preceded by a table of contents and concluded with a detailed index. As it was upon its original publication, The Commentaries on the Laws of England remains a surprisingly readable text. It is for this reason that Blackstone's work became so influential in the first place, as this feature made his books accessible by the layperson. While the first volume of the set may prove more interesting for some readers, as it details the rights of persons, this volume is still fascinating for its insight into a feudal society's perspective of property. The Commentaries on the Laws of England was a monumental text upon its original publication, and remains a work of great historical significance. Anybody interested in legal history, particularly in the British or American realms, will find this to be an important and fascinating read. Excerpt from Commentaries on Statute and Constitutional Law and Statutory and Constitutional Construction IN presenting these Commentaries to the public, I have to admit, that owing to circumstances beyond my control, they are not as full, and complete as I could wished to have made them. Many branches of constitutional law within the appropriate range of my subject, remain untouched, and in many instances, those that have been treated of, necesari ly have been but partially considered. It is to be regret ted, that a subject of so much importance at the present time, had not received the consideration of an abler mind, or that what has been done by me, had not been executed in a better manner. I am conscious of defects in What I have done, but the defects that do exist in this work, so far as constitu tional law is concerned, are supplied to a great extent, by the previous able, and distinguished Commentaries of the late Mr. Justice Story. With such a predecessor on any subject, and especially that of constitutional law, the mind naturally shrinks in distrust of its own powers, to travel even at a remote distance, along the path which has been illuminated and ren dered brilliant by his refined and cultivated intellect. That distrust is heightened, when it is considered, he had great Opportunities to acquire much learning on this subject; hav ing for many years occupied a seat in the highest, and I hes itate not to say, the ablest judicial tribunal, which ever adorn ed the jurisprudence of any nation that too, at a period when the constitutional law of a New World, was the theme of fo rensic discussion, and judicial determination, by a galaxy of forensic and judicial talent, unsurpassed in point of brilliancy.
