"It is commonly assumed that the state must provide the law necessary to maintain a peaceful and orderly society, to regulate the market, and to protect the environment. In this part of the book, I argue that these assumptions derive from a false dilemma-from the belief that the only options are legal regulation by the state and no regulation. This overlooks a third option-the regulation of human behavior by binding rules that emerge from human interaction; most importantly, by common law civil liability. I argue that the recognition of this third possibility implies that a proper analysis requires a comparative assessment of the effectiveness of state-created law and emergent law. Chapter 1 offers such an assessment of the criminal law and tort law as mechanisms for reducing violence sufficiently to allow human cooperation and prosperity. Chapter 2 offers a comparative assessment of legislation and common law as mechanisms for ensuring that market exchanges do not impose costly, unconsented to harm of third parties. And Chapter 3 offers a similar assessment of legislation and common law as mechanisms for preventing environmental degradation"--

Traditional theories of American political development depict the American state as a thoroughly liberal state from its very inception. In this book, first published in 1992, Karen Orren challenges that account by arguing that a remnant of ancient feudalism was, in fact, embedded in the American governmental system, in the form of the law of master and servant, and persisted until well into the twentieth century. The law of master and servant was, she reveals, incorporated in the US Constitution and administered from democratic politics. The fully legislative polity that defines the modern liberal state was achieved in America, Orren argues, only through the initiatives of the labor movement in the late nineteenth and early twentieth centuries, and was finally ushered in as part of the processes of collective bargaining instituted by the New Deal. This book represents a fundamental reinterpretation of constitutional change in the United States and of the role of American organized labor, which is shown to be a creator of liberalism, rather than a spoiler of socialism.

This book is a large-scale historical reconstruction of liberal legalism, from its inception in the mid-nineteenth century, the moment in which the jurists forged the alliance between political liberalism and legal expertise embodied in classical private law doctrine, to the contemporary anxiety about the possibility of both a liberal solution to the problem of political justification and of law as a respectable form of expert knowledge. Each stage in the history is a moment of synthesis between a substantive and a methodological idea. The former is the liberal political theory of the period, purporting to provide a solution to the problem of political justification. The latter is a conception of legal method or science, supposedly vindicating the access of the expert to the political choices embodied in the law. Thus, each moment in the history of liberal legalism integrates a political theory with a jurisprudential conception. Although it reaches the unsettling conclusion that liberal legalism has largely failed by its own standards, the book urges us to avoid quietism, scepticism or cynicism, in the hope that a deeper understanding of the fragility of our values and institutions inspires a more thoughtful, broadminded and nurtured citizenship.
