Southern African Development Community Land Issues written by Ben Chigara and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-03 with History categories.

This book constitutes volume one of a two volume examination of development community land issues in Southern Africa. In this volume, Ben Chigara undertakes a holistic inter-disciplinary evaluation of the legitimacy of colonial and emergent post-colonial rule property rights in affected States of the Southern African Development Community (SADC). It particularly focuses on intensifying litigation in national courts, the SADC Tribunal, and more recently the Washington based International Centre for the Settlement of Investment Disputes (ICSID) regarding counter claims to title to property. The book examines cultural, economic and political drivers at the core of SADC land issues, focusing on their significance and potential to contribute to the discovery of a new, sustainable land relations policy that guarantees social justice in the distribution of all the advantages and disadvantages relating to the allocation and use of land. Chigara shows that persistent systematic administrative failures by pre-colonial, colonial and post-colonial authorities have made for a very complex challenge that requires Solomonic tools that neither the Courts alone, nor human rights centric morality alone could resolutely attend. The book recommends a sophisticated systematic new approach to SADC land issues, which is developed in volume two, Re-conceiving Property Rights in the New Millennium. This book will be of great interest to students and researchers of Property and Conveyancing Law, Human Rights Law and Land Law.

In Indonesia, logging and oil palm concessions attributed by the government have caused high rates of deforestation and forest degradation. Community land rights have been generally ignored, on the pretext of development needs and general interest. In reaction, a growing number of civil society organizations (CSOs) have addressed these environmental and social issues at the national level. With the introduction of the decentralization process following the fall of the dictator Suharto in 1998, land-use planning became relevant at the province and regency levels. The Kapuas Hulu regency in West Kalimantan revised its land-use plan in 2010. A variety of CSOs have tried to influence land-use planning (LUP) processes and community land-rights issues in Kapuas Hulu. Few international conservation NGOs have used soft lobbying approaches with the Kapuas Hulu Government. They contribute to the policy decision-making process and to field project implementation. At the same time, at the province scale, a large Indonesian CSO coalition challenged the government and criticized the lack of civil society participation and community land-rights recognition during the LUP process. Thus, CSOs play various roles in LUP and community-rights issues using different strategic approaches at different scales.

The Community Land Trust Reader written by John Emmeus Davis and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-05-14 with Community development categories.

The community land trust is an innovative form of tenure that combines common ownership of land with individual ownership of any buildings that are located upon that land. It first appeared in the United States forty years ago. An outgrowth of the southern Civil Rights Movement, the community land trust (CLT) was conceived originally as a mechanism for African-American farmers to gain access to agricultural land. It soon found many other uses, including affordable housing and neighborhood revitalization. It soon spread to urban, suburban, and rural communities throughout the country. There are now over 200 CLTs in 44 states and the District of Columbia. They are appearing in other countries as well, with CLTs being developed in Canada, England, Scotland, and Australia. The Community Land Trust Reader brings together for the first time the seminal texts that inspired and defined the CLT. Selections trace the intellectual origins of an eclectic model of tenure that was shaped by the social theories of Henry George, Ebenezer Howard, Ralph Borsodi, and Arthur Morgan and by social experiments like the Garden Cities of England and the Gramdan villages of India. The Reader does not look only to the past, however. Many of its 46 essays and excerpts examine contemporary applications of the CLT in promoting homeownership, spurring community development, protecting public investment, and capturing land gains for the common good. The Reader also looks ahead to challenges and opportunities likely to affect the future development of CLTs, here and abroad.

Land Law Reform In Eastern Africa Traditional Or Transformative written by Patrick McAuslan and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-06-26 with Law categories.

Land Law Reform in East Africa reviews development and changes in the statutory land laws of 7 countries in Eastern Africa over the period 1961 – 2011. The book is divided into two parts. Part 1 sets up the conceptual framework for consideration of the reforms, and pursues a contrast between transformational and traditional developments; where the former aim at change designed to ensure social justice in land laws, and the latter aim to continue the overall thrust of colonial approaches to land laws and land administration. Part 2 provides an in-depth and critical survey of the land law reforms introduced into each country during the era of land law reform which commenced around 1990. The overall effect of the reforms has, Patrick McAuslan argues, been traditional: it was colonial policy to move towards land markets, individualisation of land tenure and the demise of customary tenure, all of which characterise the post 1990 reforms. The culmination of over 50 years of working in this area, Land Law Reform in East Africa will be invaluable reading for scholars of land law, and of law and development more generally.

In Montreal in 1968, speculators announced their 'urban renewal' plan to demolish six blocks of the downtown heritage neighborhood of Milton Parc in order to build enormous high-rise condos, hotels, office buildings, and shopping malls. The local community viewed this as a declaration of war. What followed was a remarkable struggle that not only saved the heritage architecture from destruction but also protected local residents from gentrification through the creation of the largest nonprofit cooperative housing project on an urban community land trust in North America. And Milton Parc is not unique. Villages in Cities takes us across North America-to New York, Boston, Burlington, Oakland, Jackson, Montreal, Toronto, Ottawa, and Vancouver-to show concrete examples of citizens taking back the land and claiming their right to secure housing. The book draws connections among these projects, examines their underlying causes, and connects them with a holistic "e;Right to the City"e; movement that is emerging internationally.
