To a disturbing degree, we are at the mercy of our time and place. While law may provide relief for some of life's troubles, that requires access to justice. Accessibility is the focus of this volume, which expands analysis of access to justice beyond the US and the UK to Asia and other comparative jurisdictions. Chapters characterise access to justice dynamics in these jurisdictions by addressing how access is understood, how it is achieved or not achieved, and how the jurisdiction should improve. The book addresses some issues seldom addressed in analyses of western jurisdictions, such as paid mandatory legal services and mandatory public interest activities, and provides English translations of relevant regulations. The book expands our understanding of access to justice with a comparative perspective, one that allows readers to identify relationships between access and its constitutive environment.

Lawyers In 21st Century Societies written by Richard L Abel and has been published by Bloomsbury Publishing this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-05-05 with Law categories.

This book presents an invaluable collection of essays by eminent scholars from a wide variety of disciplines on the main issues currently confronting legal professions across the world. It does this through a comparative analysis of the data provided by the reports on 46 countries in its companion volume: Lawyers in 21st-Century Societies: Vol. 1: National Reports (Hart 2020). Together these volumes build on the seminal collection Lawyers in Society (Abel and Lewis 1988a; 1988b; 1989). The period since 1988 has seen an acceleration and intensification of the global socio-economic, cultural and political developments that in the 1980s were challenging traditional professional forms. Together with the striking transformation of the world order as a result of the fall of the Soviet bloc, neo-liberalism, globalisation, the financialisation of capitalism, technological innovations, and the changing demography of lawyers, these developments underscored the need for a new, comparative exploration of the legal professional field. This volume deepens the insights in volume 1, with chapters on legal professions in Africa, Latin America, the Islamic world, emerging economies, and former communist regimes. It also addresses theoretical questions, including the sociology of lawyers and other professions (medicine, accountancy), state production, the rule of law, regional bodies, large law firms, access to justice, technology, casualisation, cause lawyering, diversity (gender, race, and masculinity), corruption, ethics regulation, and legal education. Together with volume 1, it will inform and challenge conceptions of the contemporary profession, and stimulate and support further research.

This book attempts to convey some of the challenges that those wielding the law for social change purposes have faced and the successes they have achieved. By intention, it is more a studied appreciation than a critical analysis of their efforts. We asked an international team of consultants to help us document and describe how various law-based strategies have worked in very different settings, to draw out connections between those efforts, and to highlight some of the insights that emerge from grantees' experiences in law-related work. We also asked them to help us learn more about the ways the Foundation has played a role in these efforts. Known as the Global Law Programs Learning Initiative (GLPLI), this effort is not definitive, but rather suggestive. Our goal is to contribute to more serious future reflection and, ultimately, more effective programs in this field.

In recent years, there have been impressive gains in reforming laws to recognise women's rights. However, women continue to lack control over resources, access to services, voice in decision-making and protection from violence. The UN Women's report, Progress of the World's Women 2010/2011 will focus on women's access to justice. It will identify effective strategies employed by governments, civil society and multilateral organizations worldwide to expand women's access to justice and rights.

Judges And Democratization written by B. C. Smith and has been published by Taylor & Francis this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-11-18 with Political Science categories.

This second edition examines judicial independence as an aspect of democratization based on the premise that democracy cannot be consolidated without the rule of law of which judicial independence is an indispensable part. It pays particular attention to the restraints placed upon judicial independence and examines the reforms which are being applied, or remain to be adopted, in order to guard against the different kinds of interference which prevent judicial decisions being taken in a wholly impartial way. Focusing on the growing authoritarianism in the new democracies of Eastern Europe, Latin America, Asia and Africa, the book analyses the paradox of judicial activism arising from the independence endowed upon the judiciary and the rights bestowed on citizens by post-authoritarian constitutions. Finally, it asks how judicial accountability can be made compatible with the preservation of judicial independence when the concept of an accountable, independent judiciary appears to be a contradiction in terms. This book will be of key interest to scholars and students of judicial studies, democratization and autocratization studies, constitutionalism, global governance, and more broadly comparative government/politics, human rights and comparative public law.

The COVID-19 pandemic has reshaped life across the world, placing people at risk as our responses to it alter not only health and wellbeing but also governance, economies, social relations, and our interaction with the natural environment. This volume draws globally recognized human rights scholars and practitioners into dialogue over the costs and consequences of the pandemic. With insights and data from fields as diverse as medicine, anthropology, political science, social work, business, and law, these contributors help us make sense of the pandemic’s ongoing effects and its potential impact on future systems and processes. Drawn from two special issues of The Journal of Human Rights—one published within eight months of the first lockdowns, the other published almost two years into the pandemic—this book offers one of the most comprehensive collections of such research available. It will be of interest to researchers and advanced students of Politics, Sociology, Social Work, Economics, Anthropology, Social and Political Geography, and Public Policy.

Untapped Power written by Carla Koppell and has been published by Oxford University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2022-02-01 with Political Science categories.

Untapped Power provides extensive insight into why and how to advance diversity, equity and inclusion when promoting development, and addressing fragility and violent conflict. Urgent challenges relating to diversity and inclusion are universal. The global #MeToo and #BlackLivesMatter movements as well as the push for LGBTQ+ rights are all emblematic of a growing interest in and focus on how to better embrace and capitalize on diversity. Yet these social movements exist alongside renewed efforts to constrain minority rights and stem immigration around the world. In Untapped Power, Carla Koppell has assembled a leading group of scholars, policy makers, researchers, and activists to provide a comprehensive overview for understanding and navigating these countervailing forces, so that we can build a more peaceful and inclusive world. This book synthesizes theory, research, and analysis to show why an enduring global commitment to diversity and inclusion is essential, and how to advance that agenda in practical terms. It considers major scholarly theories and analytical frameworks underlying the case for a focus on diversity and inclusion; analyzes diversity trends and movements for inclusion; outlines specific strategies and approaches for promoting inclusion throughout peacebuilding and development processes; and discusses priorities to advance the agenda through research, advocacy, financial investments, and programming. A guide to one of the most pressing issues in world politics, this book will be essential for anyone working in the fields of global development, conflict resolution, or peace building.
