This is the first EU competition law treatise that fully integrates economic reasoning in its treatment of the decisional practice of the European Commission and the case-law of the European Court of Justice. Since the European Commission's move to a "more economic approach" to competition law reasoning and decisional practice, the use of economic argument in competition law cases has become a stricter requirement. Many national competition authorities are also increasingly moving away from a legalistic analysis of a firm's conduct to an effect-based analysis of such conduct, indeed most competition cases today involve teams composed of lawyers and industrial organisation economists. Presentación México cuenta con dos autoridades de competencia, el Instituto Federal de Telecomunicaciones y la Comisión Federal de Competencia Económica, ambos órganos constitucionales autónomos que se crearon con motivo de la reforma constitucional en materia de competencia económica y telecomunicaciones, publicada en el Diario Oficial de la Federación el 11 de junio de 2013. Estos órganos autónomos tienen competencias específicas, el Instituto es la autoridad de competencia económica en los sectores de telecomunicaciones y radiodifusión, y la Comisión es la autoridad de competencia en el resto de los sectores económicos. El Instituto y la Comisión tienen la obligación de hacer cumplir la Ley Federal de Competencia Económica, la cual tiene un objeto claro: “[…] promover, proteger y garantizar la libre concurrencia y la competencia económica, así como prevenir, investigar, combatir, perseguir con eficacia, castigar severamente y eliminar los monopolios, las prácticas monopólicas, las concentraciones ilícitas, las barreras a la libre concurrencia y la competencia económica, y demás restricciones al funcionamiento eficiente de los mercados”. Para cumplir lo anterior, el Instituto y la Comisión en virtud de sus facultades pueden emitir requerimientos de información, cosas y documentos que tengan relación con hechos que investiguen ambos órganos o que estén relacionados con sus procedimientos en trámite. Esta obligación de cooperar de los agentes económicos con las autoridades de competencia está prevista en el artículo 119 de la Ley Federal de Competencia Económica, mientras que la facultad de las autoridades investigadoras de ambos órganos de requerir información y documentos tiene su fundamento en el artículo 73 de la referida ley. En este sentido, el Instituto y la Comisión pueden imponer multas como medidas de apremio para hacer cumplir sus determinaciones, o bien, multas como sanción en caso de incurrir en diversos comportamientos sancionados por la Ley Federal de Competencia Económica. En razón de lo anterior, conocer los criterios del Poder Judicial de la Federación en materia de multas que imponen las autoridades de competencia se hace más que necesario, a fin de fortalecer estos mecanismos que tienen como finalidad hacer cumplir sus determinaciones como sancionar conductas prohibidas por la ley, motivo por el cual se ha elaborado la presente publicación, con la intención de divulgar los criterios de la autoridad judicial de la federación, constituyendo importante actividad judicial especializada en competencia económica.
