This book is a practical guide to the provisions of the Act, which makes substantial changes to the UK competition law regime. Issues covered include: reform of merger control provisions; cartel criminalization; provision for market investigations in place of the scale and complex monopoly provisions of the Fair Trading Act; and new procedures for civil remedies and "super complaints". Consequential amendments are also made to the Competition Act 1998, and there are changes to the institutional arrangements, appeals and civil rights as well, all of which are explored here. The relevant text of the Act - both sections and schedules - is included.

The Office of Director General of Fair Trading will be replaced (with effect from 1 April 2003) by the Office of Fair Trading (OFT). New independent competition bodies will take decisions on merger and market investigations using competition-based tests rather than the current public interest test. A maximum penalty of five years in prison will deter individuals who dishonestly operate hardcore cartels. Victims of anti-competitive behaviour will find it easier to bring claims for damages for losses due to anti-competitive behaviour. Stop Now Orders will be extended to protect consumers from traders who do not meet their legal obligations. The OFT will be obliged to respond within 90 days to 'super-complaints' from consumer bodies. In insolvency cases , the use of administrative receivership will be restricted and the balance will be shifted in favour of administration. The Crown's preferential right to recover unpaid taxes ahead of other creditors, will be abolished. Almost all bankrupt individuals will be automatically discharged after a maximum of 12 months. Reforms to the Insolvency Services Account will mean that creditors receive the maximum possible investment return.

Competition law, at both the EC and UK levels, plays an important and ever-increasing role in regulating the conduct of businesses. Based on the premise that open and fair competition is good for both consumers and businesses, competition law prevents businesses from entering into anti-competitive agreements and from abusing their dominant market position. Competition Law and Policy in the EC and UK looks at how competition law affects business, including: co-ordinated actions; pricing behaviour; take-overs and mergers; and state subsidies. It provides a clear guide to and outline of the general policies behind, and the main provisions of EC and UK competition law. Information is presented within a structured framework, complete with a glossary of useful terminology. This fourth edition has been revised and updated to take into account developments since publication of the previous edition, including expanded coverage of the regulation of cartels, the development of private enforcement, the consideration of IP issues in Microsoft, and extended discussion of UK competition Law.

Competition, or anti-trust, law concerns the regulation of competition and is designed to ensure that the competitive dynamic on a market is maintained. Given the rise in market based economies, the jurisdictions which have adopted competition law regimes have expanded significantly over the last decade. In this way competition law can be seen as the combination of law, policy and economics. This book considers the competition regimes operated by the European Union, the United States and the United Kingdom. It focuses on three broad areas of regulation within these jurisdictions: anti-competitive agreements, abuse of dominance and merger control. Within these broad categories other important issues are considered, such as the enforcement of competition rules, the relationship with intellectual property rights and the underlying economic and commercial considerations on which the law is based.
