Der öffentliche Dienst ist durch seine weitgehende rechtliche Ausgestaltung gekennzeichnet. Normen des Dienstrechtes sowie des Organisationsrechtes determinieren in umfassender Art das Verhalten der Beamten und der Vertragsbediensteten der Gebietskörperschaften.Gegenstand dieser Arbeit ist die Untersuchung, ob mit Compliance ein weiteres Führungsinstrument im Verwaltungsbereich sinnvoll eingesetzt werden kann. Dabei ist der Frage nachzugehen, ob Compliance bezogen auf die Verwaltung in Organisation und Inhalten als verschiedenartig gegenüber dem privaten Bereich zu betrachten ist dies vor allem unter dem Hintergrund des Legalitätsprinzips und der sich daraus ergebenden Anforderungen an ein Compliance-Programm im öffentlichen Sektor. Ebenso soll auf Strukturprobleme, wie etwa dem Verhältnis zwischen Compliance und Corporate Social Responsibility oder den vom Bundesministeriengesetz vorgegebenen Organisationsstrukturen eingegangen werden. Weiters ist zu diskutieren, welche Compliance-Inhalte im Verwaltungsbereich zum Einsatz gelangen können und welche Möglichkeiten in Bezug auf die Organisation von Compliance im öffentlichen Dienst bestehen. Anhand des Projektes im Rahmen der Strategie INNEN.SICHER. des Bundesministeriums für Inneres sind Überlegungen anzustellen, wie Compliance in das Organisationsgefüge eines Ressorts implementiert werden kann. Durch Betrachtung der Literatur und des Rechtsrahmens, aber auch durch Experteninterviews soll ein erster Ansatz zur Beantwortung der aufgeworfenen Themen gefunden werden. *****Public service is characterized by its fundamental legal basis. Public sector employment law and organizational law determine the behavior of officials and employees in civil service.The aim of this Masters Thesis is to investigate whether compliance is to be considered an additional management instrument which can be usefully employed in the field of public service. In this context, the author focuses on the question if there are specific organizational and content-based differences between compliance in the private and the public sector. Furthermore, structural issues are examined, such as the relation between compliance and corporate social responsibility, or the content and the organizational form of compliance in the public sector. Based on the Compliance project within the strategy called INNEN.SICHER. of the Federal Ministry of the Interior of Austria, this thesis considers how compliance can be implemented into the existing structures of a public authority. This is done by an analysis of the relevant literature and the legal framework as well as expert interviews.
