Este livro é o resultado da pesquisa que teve início na Faculdade Mineira de Direito da Pontifícia Universidade Católica de Minas Gerais e cujo objetivo é pensar o estatuto da cientificidade do direito. O alcance desse propósito geral implicava a leitura, compreensão e reflexão sobre duas das teorias contemporâneas mais relevantes, no entendimento dos pesquisadores, sobre a sociedade e o direito, a saber, a teoria da ação comunicativa de Jürgen Habermas e a teoria dos sistemas sociais, de Niklas Luhmann. A primeira tarefa enfrentada foi questionar o termo pós-modernidade no campo das ciências sociais e do sistema jurídico, pois se trata de expressão carente de referência e é conceitualmente equivocado. Nesse sentido, buscamos expor a concepção de modernidade em Habermas e Luhmann, à luz da teoria dos jogos de linguagem. Para chegar às conclusões aqui expostas, que nos respondem a tal questionamento, foi necessário pensar reconstituir as mudanças no uso do conceito de modernismo, de modo a diferenciá-lo de modernidade para, ao final, mostrar como a utilização inidônea daquele termo em referência a este gerou os equívocos expressos pela expressão "pós-modernidade. Assim, a presente obra convida os leitores às reflexões que, por meio da teoria da linguagem e da significação, nos atestaram a impertinência do termo pós-modernidade, já que a ausência da descrição válida do que seja a modernidade torna impossível ultrapassá-lo para propor a existência da pós-modernidade.
