Tre anni fa (15-16 giugno 2007) nel corso del Convegno "Prevenzione delle condotte suicidarie nel carcere minorile" veniva presentato il risultato di una ricerca locale condotta dal Centro per la Giustizia Minorile di Roma in collaborazione con il Garante dei Detenuti del Comune di Roma e il Dipartimento di Scienze Neurologiche, Psichiatriche e Riabilitative dell'Università "La Sapienza" di Roma. Esperti clinici italiani e stranieri offrivano il loro elevato contributo di conoscenza ed esperienza diretta alla comprensione del fenomeno. Progressivamente ha preso forma l'esigenza di avviare un'analisi e un confronto sulla dimensione del fenomeno rispetto all'intero contesto della giustizia minorile, delle carceri in generale, nonché della società civile. Avere un quadro di riferimento complessivo e corredato di dati statistici consente di integrare in una visione unitaria i fattori di rischio legati alla vulnerabilità dei ragazzi in età evolutiva e quelli connessi alla condizione di ragazzi "devianti" in una situazione "ambientale" di privazione della libertà. L'esplorazione del fenomeno all'interno degli Istituti penali per i minorenni è basata sul fatto che il carcere costituisce di per sé un fattore di rischio e che l'ascolto degli operatori del carcere rappresenta la valorizzazione di un sapere esperto, concreto da cui trarre indicazioni per conoscere il fenomeno, ridurne i rischi, individuare soluzioni organizzative ed ipotesi operative. Pertanto, accanto alla finalità divulgativa, di far conoscere il fenomeno nella sua dimensione quantitativa e contribuire ad una informazione eticamente corretta su eventi la cui tragicità non deve essere nascosta o negata, questo lavoro di studio e analisi, che si presenta quale prima ricerca in Italia, nel settore, vuole evidenziare e suggerire direzioni di intervento, per far sì che la conoscenza del quotidiano possa trasformarsi in politiche e risposte istituzionali strutturate. Questo 2° Rapporto sulla devianza minorile, che vede la luce alle soglie del 2014, sembra voler marcare il segnale che a distanza di quasi venticinque anni, ossia dal 1988, la Giustizia Minorile, ha assimilato, nella quotidianità del lavoro di tutti coloro che operano nel settore, l'idea che educare o rieducare un minore sia un'operazione complessa e faticosa da giocarsi nei luoghi della vita e non nei luoghi della reclusione. I dati presentati in questo lavoro segnano il passaggio ad una Giustizia Minorile proiettata sul territorio, centrata sulla qualità del progetto socio-educativo, orientata a promuovere empowerment nella famiglia e della giustizia riparativa. Questo lavoro non è solo una risposta alla necessità di un aggiornamento dei dati ma ha inteso avviare, in una fase di evidente trasformazione dell'utenza, un momento di riflessione, sia all'interno del sistema minorile che nello scenario più allargato e condiviso con i diversi attori sociali che a vario titolo s'interessano e si prendono cura degli adolescenti che entrano nel circuito penale. I dati oggetto di analisi del Rapporto prendono in considerazione l'anno 2012 ed il periodo intercorso dal 2008, disegnando una rappresentazione della devianza, del sistema di funzionamento degli interventi e delle azioni predisposte, con uno sguardo alle direzioni ed ai cambiamenti emergenti dalle realtà territoriali, dati messi in relazione in una logica temporale. Anche questo volume nasce dalla collaborazione tra il Dipartimento per la Giustizia Minorile e i Servizi della Giustizia Minorile, dall'integrazione delle competenze, professionalità e saperi differenti, tra chi è vicino e accompagna le storie di devianza e criminalità e chi svolge azioni strutturali e di supporto attuate a livello di amministrazione centrale e decentrata, in un mix di conoscenze collaborative a cui si è provato a dare forma. Questo plurale è riconoscibile nell'articolazione del Rapporto stesso che vede una prima parte dedicata ai dati nazionali. In questa area viene presentata la dimensione nazionale partendo dal sistema dei Servizi. I dati presentati e commentati riguardano gli andamenti dell'utenza degli Uffici di Servizio Sociale per i Minorenni, degli Istituti Penali per i Minorenni, dei Centri di Prima Accoglienza e delle Comunità. Tra gli aspetti emergenti del lavoro, seguono delle interessanti centrature su quattro focus relativi a nuclei ritenuti centrali nei Servizi della Giustizia Minorile quali: i minori stranieri, l'utenza femminile, i giovani adulti e la recidiva. La sezione centrale è dedicata alle riflessioni di tre esperti, Lamberto Bertolè, Luigi Regoliosi, Patrizia Patrizi che, a diverso titolo, sono vicini e collaborano con i Servizi della Giustizia Minorile e che in questo spazio ringraziamo per la generosa collaborazione. Abbiamo posto loro alcune domande e le loro riflessioni costituiscono un'importante finestra aperta su mondi esterni ma vicini alla Giustizia Minorile dove emergono aree di criticità ma anche di possibili innovazioni. La terza sezione declina il dato nazionale nelle articolazioni regionali. Gli operatori dei Centri per la Giustizia Minorile hanno ragionato sui propri dati presentando le differenze e le specificità presenti a livello territoriale.

Why are certain methods of punishment adopted or rejected in a given social situation? To what extent is the development of penal methods determined by basic social relations? The answers to these questions are complex, and go well beyond the thesis that institutionalized punishment is simply for the protection of society. While today's punishment of offenders often incorporates aspects of psychology, psychiatry, and sociology, at one time there was a more pronounced difference in criminal punishment based on class and economics. Punishment and Social Structure originated from an article written by Georg Rusche in 1933 entitled "Labor Market and Penal Sanction: Thoughts on the Sociology of Criminal Justice." Originally published in Germany by the Frankfurt Institute of Social Research, this article became the germ of a theory of criminology that laid the groundwork for all subsequent research in this area. Rusche and Kirchheimer look at crime from an historical perspective, and correlate methods of punishment with both temporal cultural values and economic conditions. The authors classify the history of crime into three primary eras: the early Middle Ages, in which penance and fines were the predominant modes of punishment; the later Middle Ages, in which harsh corporal punishment and capital punishment moved to the forefront; and the seventeenth century, in which the prison system was more fully developed. They also discuss more recent forms of penal practice, most notably under the constraints of a fascist state.The majority of the book was translated from German into English, and then reshaped by Rusche's co-author, Otto Kirchheimer, with whom Rusche actually had little discussion. While the main body of Punishment and Social Structure are Rusche's ideas, Kirchheimer was responsible for bringing the book more up-to-date to include the Nazi and fascist era. Punishment and Social Structure is a pioneering work that sets a paradigm for the study of crime and punishment.

The suicide rate in prisons in England and Wales is 40 per 100,000 - four times that of the general population. How can this be explained? Recent prison suicides have aroused much public concern and media attention, yet there has been very little research examining their true cause or nature. Previous studies have tended to rely exclusively on official statistics and prison records, and have had little effect in practice. Suicides in Prison is the first major study in this area to draw directly on the experiences of both prisoners and staff. The interviews conducted by the author help to cast new light on the circumstances which can lead to suicide or attempted suicide. The author provides further evidence to support the growing recognition that suicide is not an exclusively psychiatric problem. The coping mechanisms and social support given to the people involved can have a crucial role to play. Alison Liebling also shows how serious difficulties in the management of prisoners at risk of suicide may be exacerbated by problems of communication between departments, and that prison officers may lack the necessary training to play a potentially major role in suicide prevention.
