In the context of the debate about the reform of electricity markets in Europe, this document proposes a new electricity market architecture. It is based on two pillars: (i) a well-functioning short-run energy market; and (ii) a set of efficient and equitable long-run contracts, signed between firms and the regulator on behalf of all consumers. The design of long-term contracts takes into account the characteristics of the various technologies in order to strike the right balance between exposing them to the short-run price signals while de-risking the investments. The proposal would facilitate the achievement of carbon-free and diversified power markets, allowing for substantial reductions in the cost of electricity for consumers. The proposed design is mostly in line with the recent European Commission (2022b)’s proposal, and it further provides details on key elements that the European Commission has not yet specified.

Traditionally, European energy market regulation has dealt with electricity and gas from a market-oriented perspective in the effort of creating a common internal energy market to foster economic efficiency, security of supply and competitiveness. To a lesser extent, EU law also deals with oil, shale gas and other unconventional hydrocarbons - industries outside of this contribution's scope. The content of EU energy market regulation initially focused on the transition from public monopolies of vertically integrated energy companies to a competitive market. The new set of rules contained in the CEP go a step further in the strengthening of the Energy Union, and they seek to adapt the rules dealing with electricity, renewable energy sources, energy efficiency and regulatory energy agencies to rapid the technological changes we have witnessed over the past decade in Europe.Two factors are key in understanding the reasons behind the regulatory changes and the content of the CEP, which we discuss in this chapter. Energy markets in Europe have been and are currently being transformed due to the integration of renewables into the grid. This brings forth technical and legal challenges for the transformation of "smart markets" in energy as already seen in 2011 by the German Bundesnetzagentur. These changes in generation and consumption require that the market sends the right signals to guide both the generation, consumption and transmission patterns for the future grid. The second guiding element of the CEP is also connected to those technological changes as they now have made possible the active participation of the end-consumer as a responsive and responsible 'prosumer'

The role of government and regulation in the construction of regional interconnections and enabling cross-border trade in electricity over long distances is crucial. Only integrated electricity markets and well-designed regulatory frameworks can deliver and maintain cost-effective electricity systems. Interconnected electricity systems, in their turn, can contribute to the objectives of low carbon economy, as cross-border electricity networks can integrate large-scale renewable energy sources. This paper explores the challenges related to the regulatory environment for the construction of cross-border electricity transmission links. It looks at regulatory aspects and public international law issues of cross-border energy trade and investment and international and regional cooperation related to the construction of cross-border electricity networks. First, it examines the right to construct transmission under the law of the World Trade Organization (WTO), focusing on the transit provisions of Article V of the General Agreement on Tariffs and Trade (GATT) and related obligations under the Agreement on Subsidies and Countervailing Measures (ASCM). Second, it discusses rights and obligations arising from the participation at energy-specific international treaties, such as the non-impediment obligation under Article 7 of the Energy Charter Treaty. Third, it looks at the potential of creating legal guarantees for investors under regional trade and energy-specific agreements. The paper draws on existing case law and the experience with electricity market regulations and energy investment regimes in the European Union.
