En este libro, el profesor Allan R. Brewer-Carías estudia la Constitución de la República de Colombia sancionada el 30 de agosto de 1821, por el Congreso general reunido en la Villa de Nuestra Señora del Rosario de los valles de Cúcuta, con la cual, en la América meridional se estableció la que bien podría calificarse como la única República "Bolivariana" en América, creada bajo la concepción política y constitucional del Libertador Simón Bolívar luego de sus triunfos militares sobre las fuerzas españolas de invasión, integrando en una sola entidad política las antiguas provincias de Venezuela y de la Nueva Granada. Al adoptarse la denominación de "Colombia" para el nuevo Estado, el Congreso siguió la propuesta de Bolívar expresada en la "Ley Fundamental de la República de Colombia" que bajo su iniciativa fue sancionada dos años antes por el Congreso de Angostura de Venezuela el 17 de diciembre de 1819, siguiendo la denominación que había propuesto Francisco de Miranda aun cuando para todo el Continente americano. Por ello, dicha Constitución de la República de Colombia en 1821 no surgió como el simple producto de la labor de unos constituyentes reunidos en Congreso General en la Villa del Rosario de Cúcuta a partir de enero de ese año, sino que fue el producto de un largo proceso de reconstitución política del Estado independiente en la América hispana, que había sido constituido una década antes con la Constitución Federal de las Provincias Unidas de Venezuela de 21 de diciembre de 1811, que fue la primera Constitución nacional que se sancionó en toda Hispanoamérica incluso antes de la sanción de la Constitución de la Monarquía española de Cádiz de marzo de 1812. La República de Colombia de 1821 se disolvió a partir de 1830, constituyéndose con posterioridad, por lo que se refiere a las provincias de Venezuela y de la Nueva Granada, dos Estados separados: el Estado de Venezuela (1830) y el Estado de la Nueva Granada (1832).
