Half a century ago, on 16 December 1966, the UN General Assembly adopted the International Covenant on Civil and Political Rights (ICCPR) and the International Covenant on Economic, Social and Cultural Rights (ICESCR). While the adoption of the two UN human rights covenants was celebrated all over the world, their 50th anniversary has received very little attention from the international community. The present book marks this anniversary by taking stock of the first half-century of the existence of what are probably the world's two most important human rights treaties. It does so by reflecting on what the covenants have achieved (or failed to achieve) in the years that have passed, by determining and comparing their current influence in the various regions of the world, and by assessing their potential roles in the future. The book contains papers that were presented during a symposium held in Zurich in 2016, which brought together experts and stakeholders from a range of disciplines and world regions. Some fundamental issues that are addressed by the contributors are as old as the two covenants themselves. They concern, for example, the division of human rights into first- and second-generation rights, and the question of whether there should be one central monitoring body - possibly a world court - or more than just one. However, the contributors go beyond such questions that have been explored before; they develop new answers to old questions and point to new challenges.

The Unwritten Brazilian Constitution offers an unexplored topic outside Portuguese language: the leading cases on human rights in the Brazilian Supreme Court (Supremo Tribunal Federal – STF). The Brazilian Constitution of 1988 represents an institutional framework able to restructure the relationship between the powers after the military dictatorship. The constituents drafted the Brazilian Constitution in order to set an extensive system of judicial protection for fundamental rights, by means of several instruments that have strengthened access to the Judiciary. Because the Brazilian Constitution has an extensive list of fundamental rights, the STF was called to interpret them several times and it developed an unwritten understanding of these fundamental rights. These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.

A obra ora apresentada é fruto e produto da inquietação de sua autora relativamente à tutela do trabalho decente ou digno como limitação ao poder empregatício, uma vez que a questão é atual e de substantiva relevância para o Direito Constitucional do Trabalho brasileiro e internacional. E assim sendo, é inegável que somente pela realização do direito fundamental ao trabalho decente, previsto no artigo 6o da CF/88 e em vários outros dispositivos constitucionais, bem como nas Convenções da OIT, conforme aqui demonstrado, será acolhido, apreendido e respeitado o conteúdo reclamado no art. 1o, III, e caput do art. 170 da Carta Magna. A dignidade da pessoa humana, inserida neste contexto jurisdicional, encontra-se no ápice do ordenamento jurídico e constitui a unidade dos direitos e das garantias individuais e sociais, repelindo qualquer comportamento que atente contra a pessoa humana em tal dimensão. A dignidade de cada homem consiste em este ser, essencialmente, uma pessoa natural – um ser cujo valor ético é superior a todos os demais valores. Logo, tem a pretensão de contribuir para o desenvolvimento do tema, provocando a comunidade acadêmica e jurídica face à necessidade de se protegerem sempre os direitos humanos fundamentais do trabalhador.

Desde o advento da Declaração Universal dos Direitos do Homem e seus pactos posteriores, a promoção e a proteção dos direitos humanos assumiram especial patamar, com relevante atuação das Cortes Internacionais. Sob tal enfoque, é necessário um exame dos direitos humanos processuais com a finalidade de dominar os mecanismos necessários à proteção em juízo daqueles direitos humanos de natureza material, sob pena de reduzir a previsão e o estudo desses últimos à esterilidade. Nesse panorama, toma destaque o direito humano à prova, decorrendo do direito ao processo justo, considerando que ocupa ponto central na atividade processual em geral e nos procedimentos contenciosos movidos perante a Corte Interamericana de Direitos Humanos, em específico. Centraliza-se, portanto, o estudo na seguinte questão: em que medida o direto probatório se apresenta como mecanismo processual de proteção aos direitos humanos, de acordo com a sua aplicação pela Corte IDH? Para responder o questionamento, a primeira parte da obra é dedicada aos direitos humanos processuais decorrentes do processo justo. Ainda, será examinado o direito humano à prova, com sua conceituação, sua definição de natureza jurídica, suas funções e finalidades, para, em seguida, apresentar-se os sistemas de valoração da prova e o ônus da prova. A segunda parte do livro volta-se a questões relativas ao direito probatório e sua análise pela Corte Interamericana de Direitos Humanos. Para tanto, são observados os casos Escher e outros vs. Brasil e Herrera Ulloa vs. Costa Rica, versando, respectivamente, acerca dos modelos de constatação e das regras da sana critica. O ônus da prova e a possibilidade de sua dinamização, assim como suas relações com o direito humano à presunção de inocência, são estudados conjuntamente com a análise dos casos Velásquez Rodríguez vs. Honduras e Agustín Bladimiro Zegarra Marín vs. Peru, respectivamente. Pretende-se reforçar a existência de um rol de direitos humanos processuais assegurados a toda pessoa humana, com foco especial no direito humano à prova. Esse direito se constitui num mecanismo de proteção aos direitos, de natureza processual ou material, de indivíduos ou grupos que sejam violados, o que se depreende do seu conteúdo, do âmbito de alcance e da análise de casos apreciados pela Corte Interamericana.

This book provides a broad perspective of the functioning, evolution, and dynamics of the rule of law in Brazil. It stresses not only how the rule of law has developed in the legal system, but also how the political institutions and extra-legal organisations have transformed its foundations. The rule of law is not a simple concept when it comes to defining the political, economic, and legal developments of a country like Brazil. Similar to many other Latin American countries, Brazil is a young democracy struggling with its longstanding extractive institutions and entrenched interests. It features, however, one of Latin America's richest constitutional moments, when civil society actively participated in drafting the most democratic constitution in the country's history. Brazil has since strengthened its institutions and the rule of law, but the road toward consolidating them has been challenged by inequality and the legacies of that authoritarian past. The book explores how Brazilian democracy has dealt with the high levels of social inequality and the authoritarian mindset that still play a big role in its fate, and asks whether the country's democratic achievements and institutional framework are sufficiently strong to enforce the rule of law as an imperative for Brazil's development, especially in times when the country is most in need of them.
