The Constitution of the Democratic People's Republic of Korea is often dismissed as a valid legal instrument within the larger framework of the North Korean legal system. This is an unsurprising outcome given the portrayal of North Korea as a totalitarian dictatorship, documented human rights abuses, and the lack of access to the country's lawmaking processes. It is also a foreseeable result if comparisons are made to liberal democratic constitutions where rights guarantees and judicial review are defining elements. However, the North Korean Constitution deserves more nuanced scrutiny in light of evolving research on socialist and authoritarian constitutionalism in Asia. This article argues that the DPRK Constitution should be included more substantively within the analytical frameworks of Asian, socialist, and authoritarian constitutionalism by virtue of how it functions to nation-build, legitimate institutional leadership, signal ideological shifts, regulate society on collectivist, duty-based principles, and guide economic reforms for development and modernization.

After the collapse of the Soviet bloc, there are only five socialist or communist countries left in the world – China, Cuba, Laos, North Korea, and Vietnam – which constitute about one-quarter of the world’s population. Yet, there is little scholarship on their constitutions. These countries have seen varying socioeconomic changes in the decades since 1991, which have led in turn to constitutional changes. This book will investigate, from a comparative and interdisciplinary perspective, how and why the constitutional systems in these five countries have changed in the last three decades. The book then breaks the constitutional changes down into four questions: what are the substantive contents of constitutional change, what are the functions, what are the mechanisms, and what are the driving forces? These questions form a framework to process the changes the five countries have gone through, such as making new constitutions, amending current ones, introducing more rights, allowing citizens to engage in changes, enacting legislation, and defining the constitutional authority of the three state branches and their relationship with the Communist Party. While all five countries have adapted their constitutional systems, the degree, mechanisms, and influential factors are not identical and present considerable variations. This book examines and explores these differences and how they developed. Constitutional Change in the Contemporary Socialist World offers a comprehensive and holistic view of an understudied and overlooked area of constitutional law, essential for anyone studying or working in law, politics, or policy.

The Institute for Unification Education, which constitutes the Ministry of Unification of the Republic of Korea, has published annual editions of Understanding North Korea since 1972, as an endeavor to promote greater understanding of North Korea for South Korean readers. Understanding North Korea depicts the reality faced by the Northern regime in areas of politics, diplomacy, military, economy, society, culture, and many more. The May 2012 publication has been translated into English, with the aim to help the international community better understand the northern half of the Korean peninsula. English translations of the referred editions will be published on an biennial basis. We hope that this book enables readers around the world to better grasp the reality of North Korea. The regime in North Korea exhibits three characteristics: it is a totalitarian dictatorship governed by the sole leadership of the suryǒng , who stands above the Workers’Party of Korea (WPK) and the state; the regime, as one of the world’s most highly centralized and planned economies, has advocated self-reliance and the monopoly of all means of production by the state and cooperative organizations; and the state uses the concept of Grand Socialist Family which requires absolute obedience of people to the suryǒng , who is considered the father of a family. These traits engendered a peculiar form of social structure unprecedented in any other socialist country. As it had to do under Kim Jong-il, North Korea under Kim Jong-un must engage in some degree of reform and opening to improve its economy and ensure the regime’s survival. Such a path, however, also brings with it the risk of regime collapse. The regime thus faces the difficult task of maintaining stability while at the same time reforming and opening up. CONTENTS I.
