The points presenting themselves in considering this important subject, are, first, whether either the federal or state governments possess a right to distribute wealth and poverty, gain and loss between occupations and individuals. Secondly, whether the federal government possesses this right . And thirdly, supposing both or either to possess such a right, whether it is wise, or honest, or beneficial to the United States, to exercise it . To understand the rights of mankind, the powers of government, and the meaning of constitutions, we ought to ascertain the design of civil society. Man, by nature, had two rights; to his conscience, and to his labour; and it was the design of civil society, to secure these rights. In the case of religious freedom, we have seen one right; in that of the freedom of property, our vision is not so clear; yet both, as natural rights, stand on the same foundation. By suppressing the distinction between occupations, and covering all by the inclusive term, labour, we at once discern the natural equality of the right . The occupations of men are the men themselves; and every free government supposes, that it is only distinguishable from a tyrannical one by equal laws, and equal rights in its citizens. Our societies grew up from this principle, and we find nothing in our constitutions by which it is abolished. Our governments received man, animated by the creator, with a free will over his mind and his labour; and were instituted to protect the divine bounty. The freedom of conscience was made complete, because no contributions from that natural right were necessary for the support of civil government; but the freedom of labour was incomplete, from the necessity of such...

Originally published in 1814, this is a reprint of the Yale University Press 1950 edition with an introduction by Roy Franklin Nichols. 562 pp. Taylor wrote this important work in 1814 as a reply to John Adams's Defence of the Constitutions of Government of the United States of America. Unlike Adams, he rejects the concept of "a natural aristocracy" of "paper and patronage" and a federal government based on a system of debt and taxes. He considers the American government to be one of divided powers responsible to the sovereign people alone. Opposed to the extent of power awarded to the executive office, he calls for shorter terms for the president and all elected officers. Charles Beard said this work "deserves to rank among the two or three really historic contributions to political science which have been produced in the United States." JOHN TAYLOR [1753-1824] was known as "John Taylor of Caroline County, Virginia." He served in the Continental Army and later in the Virginia House of Delegates, then served three terms as a member of the United States Senate. He is considered to be one of the nation's greatest philosophers of agrarian liberalism. He was one of the nation's first proponents of states' rights. His works include New Views of the Constitution of the United States (1823), Construction Construed, and Constitutions Vindicated (1820) and A Defence of the Measures of the Administration of Thomas Jefferson. By Curtius (1804), an argument in favor of the achievements of the first Jefferson administration.

Richards, is the attempt to understand the implications of the Reconstruction Amendments--Amendments Thirteen, Fourteen, and Fifteen to the United States Constitution.
