This book advances the emergence of a new sub-field of study, the law of consumer redress, which encompasses the various dispute resolution processes for consumers, their regulations, and best practices. The book argues that the institutionalisation of alternative dispute resolution (ADR) bodies are expanding their functions beyond dispute resolution, as they are increasingly providing a public service for consumers that complements, and often replaces, the role of the courts. Although the book focuses on ADR, it also analyses other redress methods, including public enforcement, court adjudication and business internal complaints systems. It proposes a more efficient rationalisation of certified redress bodies, which should be better co-ordinated and accessible through technological means. Accordingly, the book calls for greater integration amongst redress methods and offers recommendations to improve their process design to ensure that, inter alia, traders are encouraged to participate in redress schemes, settle early meritorious claims and comply with outcomes.

The Consumer Protection from Unfair Trading Regulations 2008 (the Regulations) prohibit misleading and aggressive trade practices. The Regulations implemented a European directive, replacing 23 previous UK consumer protection measures, including most of the Trade Descriptions Act 1968. They are enforced mainly by the Office of Fair Trading and by trading standards services. Under current law, consumers do not have a right to compensation if a trader breaches the Regulations. Instead consumers must rely on a variety of private causes of action: some statutory, some based on case law. These are complex, confusing and patchy. This Consultation Paper aims to: (1) simplify redress for misleading commercial practices; (2) simplify redress for aggressive commercial practices; and (3) fill gaps in protection, where a consumer is unable to gain redress for serious breaches of the Regulations.

This joint report by the Law Commission and Scottish Law Commission considers the redress available to consumers who have been the victims of misleading or aggressive practices by traders. Currently consumers have to rely on private law rights if they want to take action. The Commissions' review found current private law in this area to be fragmented, complex and unclear, and recommends new legislation to provide redress to consumers who experience misleading and aggressive practices in their dealings with traders. The aim is to clarify and simplify the current law on misleading practices, and to improve the law on aggressive practices by filling the gaps in the current law. Limited reform, targeting the most serious causes of consumer detriment, is proposed. The report follows the Consumer Protection from Unfair Trading Regulations 2008 in most, but not all, respects. Recommendations are made on liability and remedies. Consumers would have the right to unwind the transaction (get a refund), or receive a discount on the price. Additional damages may be recoverable to compensate for additional loss. The report also considers the specific area of unfair payment collection.

Since every transaction is made under a single jurisdiction, redress is often available and effective. In contrast, in online transactions, access to redress is not easily reachable for consumers. Since e-commerce is borderless, the recourse to courts in disputes resulting from international electronic transactions is also complicated mostly due to the problem of knowing which courts shall have jurisdiction over such disputes. Following the ultimate purpose of this research, the research questions to which we attempted to respond are the following: To what extent is the existing legal framework adequate to guarantee effective e-consumer redress in Rwanda? To what extent does Rwandan law address the issue of the conflict of laws and jurisdiction in case of cross-border e-commerce vis-à-vis consumer redress? What can be done to ensure or improve the effectiveness and efficiency of e-consumer redress for cross-border disputes? This research is mostly intended to identify loopholes in Rwandan Laws with regard to issues that emerge time and again in e-commerce transactions. It specifically focuses on the availability and effectiveness of consumer redress, mechanisms thereof and institutions to put them in force. It as well tends to show failures of Rwandan Private International Rules concerning the protection of consumers, which are normally taken into account by courts while dealing with consumer-related issues consisting of a foreign element, which refers to contact with some system of law and jurisdiction other than those of the forum state.
